Consensus of the Council was to concur with the previous direction. <br /> <br />5. Improvement Project #01-15 Petition <br /> <br />City Engineer Jankowski noted that staff received a petition signed by more than 50 percent of <br />the homeowners petitioning against one of the overlay projects. The petition will be presented to <br />the Council at the next regular City Council meeting. The City has a policy that if a maintenance <br />project is defeated by petition the City will not participate in its 50 percent share on a future <br />project. He inquired if the Council wanted staff to advise the residents of that policy. The City <br />Attorney has indicated that residents can withdraw their signatures up until the time the petition <br />is submitted to the City Council. <br /> <br />Counci hnember Zimmerman inquired if there is a process to reinitiate the project. <br /> <br />City Engineer Jankowski replied that the project could not be reinitiated for one year. <br /> <br />Councilmember Hendriksen stated that any action for moving forward with the project should be <br />tabled at the next City Council meeting and then a letter should be sent to the residents informing <br />them of the City policy and giving them two weeks to respond. <br /> <br />City Engineer Jankowski replied that the only downfall would be is that the street projects would <br />be delayed for two weeks. <br /> <br />Councilmember Hendriksen inquired if they could award for all other projects except for the one <br />in question. <br /> <br />City Engineer Olson suggested advertise for bids including the project in question as an alternate. <br /> <br />Consensus of the Council was to have the City Attorney review petition and advise the Council <br />on how to proceed. <br /> <br />6. Improvement Project #00~35 (141~t and Ebony) <br /> <br />City Engineer Olson stated that the project was awarded on April 27, 2001, contingent upon City <br />Attorney review. He inquired if there was any objection to awarding the second phase of the <br />project once the proper documents are obtained. <br /> <br />Consensus was to go ahead with awarding the second phase of the project once the proper <br />documents are obtained. <br /> <br />ADJOURNMENT <br /> <br />Motion by Councilmember Hendriksen, seconded by Councilmember Zimmerman, to adjourn <br />the meeting. <br /> <br />Public Works Committee/May 15, 2001 <br /> Page 12 of 13 <br /> <br /> <br />
