Councilmember Hendriksen stated that if the grading is not right then they should not be given <br />the certificate of occupancy. <br /> <br />Councilmember Zimmerman requested that staff look at Andover's ordinance. <br /> <br />Councilmember Hendriksen stated that the problem is not limited to the builder, because <br />someone could redo their grading in the backyard and create the same problem. He thinks that it <br />is more an enforcement issue. <br /> <br />Councihnember Anderson stated that she does not like to see a situation where a person thinks <br />they are purchasing a walkout and it tums into a lookout. <br /> <br />City Engineer Olson replied that the ordinance does require an elevation survey be completed on <br />each lot. <br /> <br />Councilmember Anderson stated that some type of disclaimer should be included in the <br />ordinance indicating that the ordinance is only a City policy not a policy of other organizations. <br />She also stated that sometimes people want to create a pond to draw wildlife and she has heard <br />that that does not work. She inquired if there was an article referencing that and, if so, to include <br />it in the Ramsey Resident. <br /> <br />City Engineer Jankowski replied that he would look into that. <br /> <br />Councilmember Zimmerman replied that the main concern is not people creating ponds for <br />wildlife, but creating water areas where basements are flooded because of something the City did <br />not do. <br /> <br />Mayor Gamec stated that he would like to get the ordinance adopted and then continue working <br />on it. <br /> <br />Councilmember Hendriksen stated that there is currently an issue in Rivenwick where a neighbor <br />graded his property and caused damage on a neighbor's property. He inquired how the new <br />ordinance would impact that situation. <br /> <br />City Engineer Olson replied that both property owners had responsibility in that case. Both <br />property owners did not have the swale along the property line and the problem was created <br />because the water that ended up going into the pool is the water that drained into the neighbor's <br />property. The last person in created the problem, but it is not completely his fault. <br /> <br />Councilmelnber Hendriksen stated that he thought there was a ten-foot drainage easement on the <br />property that was filled in. <br /> <br />City Engineer Olson replied that there was, but it was done on both sides of the property line. <br /> <br />Public Works Committee/May 15, 2001 <br /> Page 6 of 13 <br /> <br /> <br />
