Councihnember Hendriksen inquired if there was anything in the ordinance to protect the injured <br />party that did not create the problem. <br /> <br />City Engineer Olson replied that many problems will be avoided because of the grades that will <br />be produced, but there is nothing to protect the person that is being damaged. <br /> <br />Councihnember Hendriksen stated that he understands that at some point it does become a civil <br />matter, but inquired if the City has the mechanisms to make sure the issue gets resolved. Could <br />the City hold the certificate of occupancy. <br /> <br />City Engineer Olson replied yes. <br /> <br />Councihnember Zimmennan stated that, as the City takes on more townhome projects, grading <br />become more critical. He inquired if there was anything in the ordinance that would require the <br />developer to do spot elevations while construction was taking place. <br /> <br />City Engineer OIson replied that spot checks would be required on the buildings with grades less <br />than two percent. <br /> <br />Councihnember Anderson inquired if Andover's ordinance would cure all of the problems. <br /> <br />City Engineer Olson replied that Andover's ordinance does address a lot of concerns, but it was <br />originally met with a lot of opposition. <br /> <br />Councihnember Anderson inquired if the Andover staff felt that the ordinance was worth the <br />opposition. <br /> <br />City Engineer Olson replied that the person he spoke with from Andover was very supportive of <br />the program. <br /> <br />Councilmember Zimmerman requested that staff research what other cities require for a <br />certificate of grading. <br /> <br />City Engineer Olson replied that he would further research the information. He inquired if staff <br />should write some additional language and bring it back for Council review, or submit the <br />ordinance as is with the additional information. <br /> <br />Consensus was that the ordinance should be introduced and have staff do further research for <br />Council consideration. <br /> <br />Public Works Committee/May 15, 2001 <br /> Page 7 of 13 <br /> <br /> <br />
