As of this moment, the City has a valid provision which is part of the <br />Charter. <br /> <br />Councilmember Anderson replied that there is still the question if the Charter is constitutional. <br /> <br />Councilmember Hendriksen replied that, at this moment, the Charter Amendment has not been <br />overruled, so at this moment it is a valid portion of the City Charter. <br /> <br />City Attorney Goodrich verified that currently the Charter Amendment is the law of the City of <br />Ramsey and has not been found to be invalid. <br /> <br />Councilmember Hendriksen inquired if it was a true statement that the primary issue is if citizens <br />have the right to implement law as a Charter rather then the Council doing so by an ordinance. <br /> <br />City Attorney Goodrich replied that was partially correct. <br /> <br />Councilmember Hendriksen stated that the longer it takes to do this the more expense occurs. <br /> <br />City Attorney Goodrich replied that was correct and is why he recommends that the City adopt <br />some form of a Density Transition Ordinance. <br /> <br />Councilmember Hendriksen stated that implementing an ordinance must be a credible reflection <br />of what is written in the Charter. <br /> <br />City Attorney Goodrich replied that if the Charter Amendment is upheld the Council is obligated <br />to include the frame work of the Charter Amendment. After a Density Transition Ordinance gets <br />adopted, an effort should be made to have a Charter Amendment reflect the Density Transition <br />Ordinance. <br /> <br />Brent Smith, 15620 Yakima Street NW, Ramsey, read the remainder of the letter that was sent to <br />Councilmember Kurak. The letter had welcomed Councilmember Kurak to the Council and gave <br />an explanation of the density ordinance. The letter also indicated that several people had put a <br />lot of time and effort in the ordinance. <br /> <br />Kerry Manuel requested that either the Council pass the proposed Density Transition Ordinance <br />or let the special election be held. <br /> <br />Councilmember Hendriksen stated that there were a couple people present to discuss the issue of <br />ACCAP. He stated that there is a policy issue in terms of what the City is going to do about the <br />purchase agreement which does not fall within the umbrella of Attorney Client Privilege.
