feels is seriously flawed. As of this moment, the City has a valid provision which is part of the
Charter.

Councilmember Anderson replied that there is still the question if the Charter is constitutional.

Councilmember Hendriksen replied that, at this moment, the Charter Amendment has not been
overruled, so at this moment it is a valid portion of the City Charter.

City Attorney Goodrich verified that currently the Charter Amendment is the law of the City of
Ramsey and has not been found to be invalid.

Councilmember Hendriksen inquired if it was a true statement that the primary issue is if citizens
have the right to implement law as a Charter rather then the Council doing so by an ordinance.

City Attorney Goodrich replied that was partially correct.

Councilmember Hendriksen stated that the longer it takes to do this the more expense occurs.

City Attorney Goodrich replied that was correct and is why he recommends that the City adopt
some form of a Density Transition Ordinance.

Councilmember Hendriksen stated that implementing an ordinance must be a credible reflection
of what is written in the Charter.

City Attorney Goodrich replied that if the Charter Amendment is upheld the Council is obligated
to include the frame work of the Charter Amendment. After a Density Transition Ordinance gets
adopted, an effort should be made to have a Charter Amendment reflect the Density Transition
Ordinance.

Brent Smith, 15620 Yakima Street NW, Ramsey, read the remainder of the letter that was sent to
Councilmember Kurak. The letter had welcomed Councilmember Kurak to the Council and gave
an explanation of the density ordinance. The letter also indicated that several people had put a
lot of time and effort in the ordinance.

Kerry Manuel requested that either the Council pass the proposed Density Transition Ordinance
or let the special election be held.

Councilmember Hendriksen stated that there were a couple people present to discuss the issue of
ACCAP. He stated that there is a policy issue in terms of what the City is going to do about the
purchase agreement which does not fall within the umbrella of Attorney Client Privilege. He
inquired when the Council would be discussing the policy issues in an open forum.

City Council/January 9, 2001
