Mayor Gamec explained that adopting the tower overlay district will not allow a tower to be <br />placed anywhere in that area. The applicant would still have to get approval from the City and <br />be subject to public hearings. <br /> <br />Ms. Zagaros suggested increasing the 1 O-acre lot size requirement to 15 to 20 acre lots. <br /> <br />Community Development Director Frolik noted that towers can be built anywhere in the City on <br />industrial property or public property. <br /> <br />Ron Hunt, 17455 Nowthen Boulevard NW, Ramsey, stated that the Planning Commission had <br />discussed the setback requirement from neighboring structures of 1.5 times the height of the <br />tower. Under that scenario, the person who is collecting the fee on the tower can place the tower <br />on the back part of the ten acres, which doesn't affect him, but does impact the neighboring <br />property. In the proposed tower overlay district, there already are gas lines and power lines <br />which has to devalue their property. His property has already been significantly devalued <br />because of the four in forty requirement. He recommended that towers be allowed on public <br />property so that the City can receive the profits of the tower. <br /> <br />Councilmember Hendriksen noted that the four in forty stipulation has nothing to do with the <br />City of Ramsey, but is a restriction of the Met Council. If the Mayor of Eagan is correct, it may <br />be that the Met Council does not have the authority to impose that restriction. He stated that if a <br />property owner is permitted to put a tower up adjacent to his property line and there is a 1.5 times <br />the height of the tower setback requirement from the adjacent building, then it encumbers the <br />neighboring property from building on his property which is wrong. <br /> <br />Mr. Hunt replied that there should be some consideration for the ad~jacent property. <br /> <br />Community Development Director Frolik stated that the ordinance could be amended so that the <br />setback has to be from the nearest property line. <br /> <br />Councilmember Kurak inquired if increasing the property size to 15 acres or 20 acres and change <br />the setback requirements and eliminate the need for the overlay district. <br /> <br />Councilmember Zimmerman recommended sending the Tower Ordinance back to Planning <br />Commission to address the setback requirements. <br /> <br />Motion by Councilmember Zimmerman, seconded by Councilmember Hendriksen, to introduce <br />an ordinance to create the Tower Overlay District. <br /> <br />Motion carried.
