Voting No: None. <br /> <br />The public hearing closed at 8:08 p.m. <br /> <br />Council Bnsiness <br /> <br />Mayor Gamec called the regular City Council meeting back to order at 8:08 p.m. <br /> <br />Motion by Councilmember Kurak, seconded by Councilmember Anderson, to authorize a <br />business subsidy agreement with Amcon Construction Company, and execution of a <br />development agreement, contingent upon review by the City Attorney. <br /> <br />Motion carried. Voting No: None. <br /> <br />Case #5: <br /> <br />Request for a Grading Permit to Grade and Export Soils; Case of North <br />Fork, Inc. <br /> <br />City Engineer Jankowski stated that on April 28, 1987, the City issued a grading permit to L & G <br />Rehbein and North Fork, Inc. to grade and excavate a lake in the Northfork P.U.D. Subsequent <br />to the issuance of that permit, the City Code pertaining to grading and mining permits was <br />amended. In April 1991, the permit was reissued in accordance with the revised regulations. In <br />August 1991, that permit was transferred from L & G Rehbein to Glenn Rehbin. The permit <br />issued to Glenn Rehbein had an expiration date of July 31, 1992. The permit lapsed and in <br />November 1995, the City issued a new permit to complete excavation of the lake area and create <br />walkout style home sites. That permit expired on February 28, 1999, prior to the exporting of the <br />materials. North Fork, Inc. has applied for a reissuance of a grading permit to construct a second <br />lake and create some walkout style building sites in the area of the proposed plat of St. Andrews <br />Addition in the Northfork Planned Unit Development (PUD). The grading plan proposed to <br />export approximately 300,000 yards of sand from the 80-acre site. This is a reduction from the <br />800,000 yards proposed in previous applications. The applicant has stated that the reduction in <br />materials to be exported is a result of decreasing the size of the lake and not trying to make all of <br />the lots full walkouts. There are several potential destinations for the exported materials: a) a <br />project in Elk River; b) City of Ramsey street improvement project to extend 153rd Avenue NW <br />east of Armstrong Boulevard NW; c) the relocation site for T & G Land in the proposed <br />Gateway Industrial Park 5; d) a Bury & Carlson project. (It was reported at the Planning <br />Commission that the fill may also be used for the outlot south of 153rd but it has been determined <br />that the fill for that site will come from excess soils southeast of Lake Itasca.)
