one resident present expressing concern with project size, erosion control, and administration of <br />the permit. Subsequent to the Planning Commission meeting, the developer supplied the City <br />with a phasing plan for the grading operations. The grading is proposed to bc accomplished in <br />accordance with the 13 sub-areas identified on the two-phase plat development plan prepared by <br />Ulteig Engineers, Inc. and dated January 12, 2001. The Planning Commission recommended <br />approval of the request and given the scope of the project, the standard $5,000 surety be <br />increased accordingly. Based on a meeting with the applicant subsequent to the Planning <br />Commission meeting, City staff recommends that the proposed findings of fact be amended to <br />reflect the receipt of a phasing plan; that the permit limit excavation to no more than two sub- <br />areas at any given time, restrict imported materials to topsoil, and the trucks must have additional <br />axles when truck traffic has no alternative but to utilize streets constructed at less than nine ton <br />standards. <br /> <br />Councilmember Zimmerman stated that he has heard concerns by residents that they have not <br />been the best on dust control in the past. <br /> <br />City Engineer Jankowski replied that those complaints were heard during the public hearing as <br />well as the complaint of them working on Saturdays. A large majority of the excavating will be <br />done yet this winter and the applicant has agreed to not do any work on the weekends. <br /> <br />Dennis Peck, Director of Development North Fork, Inc., stated that the contractor that will be <br />hired to do the grading has not yet been chosen. They are anticipating that 100,000 yards of the <br />materials will be taken out this year, and do not expect that Rehbeins will be part of the export or <br />grading. <br /> <br />City Engineer Jankowski reviewed the haul route that will be used as part of the conditions of the <br />grading permit. He stated that condition #19 of the grading permit should be amended to include <br />the route to be used when the golf course is in operation and stated that there shall be no use of <br />local roads during the spring load limitation period. <br /> <br />Motion by Councihnember Zimmerman, seconded by Councilmember Anderson, to adopt <br />Resolution #01-01-022 adopting Findings of Fact # 0545 relating to North Fork's request for a <br />grading permit to grade and export soils from Outlot C, Northfork. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Zimmerman, Anderson, <br />Hendriksen, and Kurak. Voting No: None. <br /> <br />Motion by Councihnember Zimmerman, seconded by Councilmember Anderson, to approve <br />North Fork's request for a grading permit on Outlot C, Northfork, based on the findings of fact, <br />and adopt Resolution #01-01-023 declaring terms of same as amended by City staff. <br /> <br />Motion carried.
