Motion by Councilmember Kurak, seconded by Councilmember Anderson, to adopt Ordinance <br />#01-05 to create the Tower Overlay District. <br /> <br />A roll call vote was performed by the Recording Secretary: <br /> <br />Councilmember Hendriksen aye <br />Councilmember Anderson aye <br />Councilmember Kurak aye <br />Councilmember Zimmerman aye <br />Mayor Gamec aye <br /> <br />Motion carried. <br /> <br />Case #10: Report from the Public Works Committee <br /> <br />Counciimember Zimmerman stated that the Public Works Committee met on February 20, 2001 <br />and discussed the following five cases: <br /> <br />1) <br /> <br />Request for Consideration from North Lake Properties, Inc. <br /> The Committee was directed to receive a legal opinion from the City Attorney on the <br /> wording of the resolution to determine whether it would limit the collection of the storm <br /> water impact fee to the time of platting only. The Committee also requested a legal <br /> opinion on the service removal and directed staff to research the policies of other <br /> communities regarding this issue. <br /> <br />2) <br /> <br />Consider Correspondence from Ellen Stanley <br /> The Committee suggested that grant funds for this purpose seemed unlikely. Members of <br /> the Committee also suggested that the requirement to pay assessments upon sale of the <br /> property could be considered an objectionable imposition on their property. The <br /> Committee recommended denial of the request to initiate a feasibility study on the <br /> extension of sewer and water service to Pondvale Estates. <br /> <br />3) <br /> <br />Update on 141~t Avenue NW and Ebony Street NW Improvement <br /> City Engineer Brian Olson explained that it was feasible to terminate the street <br /> construction of 141st Avenue at the west property line of St. Paul Terminals. The <br /> Co~nmittee directed staff to research the history of the Conditional Use Permit for <br /> Danny's Tranny to determine if any commitment of the subject right-of-way was made as <br /> a part ofthepermit. The Committee also directed that for thepurpose ofpreparingplans <br /> for the improvement, the street should be terminated at the west property line of St. Paul <br /> Terminals. <br /> <br />Jeff Shot, St. Paul Terminals, Inc., stated that he has had several conversations with City staff <br />and discovered that there are several issues that need to be addressed.
