CASE # <br /> <br />REQUEST FOR A CONDITIONAL USE PERMIT FOR <br />AN OVERSIZED ACCESSORY BUILDING; <br /> CASE OF JAMES AND CHERI WALLER <br /> By: Chris Anderson, Zoning & Recycling Coordinator <br /> <br />Background: <br /> <br />The City has received an application from James and Cheil Wailer for a conditional use permit to <br />exceed thc maximum allowable square footage for accessory buildings on properties between <br />i4 880 ~md 43,559 square feet as established in City Code on the property located at 17937 <br />Fluorine St NW. <br /> <br />The following items are enclosed for Your information: <br /> <br />a) Site location map <br />b) Site layout <br />c) Site picture <br />d) Draft Planning Commission meeting minutes dated May 5, 2005 <br />e) Proposed findings of fact <br /> Proposed conditional use permit <br /> <br />Noti fica rio n: <br /> <br />State statute requires notification of the public hearing to property owners within 350 feet of the <br />~;ubiect property. Staff sent out notices to all property .owners within 350 feet. <br /> <br />Observations: <br /> <br />The subject property is approximately 0.85 acres (37,168 square feet), in size and is located <br />outside the Metropolitan Urban Service Area (MUSA). According to City Code, the property is <br />eligible t-bt 1,488 square feet of accessory building space. <br /> <br />The proposed building will be 1,120 square feet (28' x 40') in size. Combined with the existing <br />attached garage (528 sq. ft.), the applicant would have 1,648 sq. ft. in accessory building space. <br />This results in an overage of 160 square feet. The applicant would like to exceed the size <br />restriction in order to construct a detached accessory building that would accommodate the <br />storage o15 private use vehicles and equipment.. <br /> <br />Thc proposed accessory building will be located in the rear yard, and will exceed all setbacks <br />established in the R-l Rural Developing District. The exterior finish of the building will match <br />that of the home and the building would not exceed the sixteen (16) foot mean gable roof height <br />restriction. Furthermore, the sidewall height of the building will be restricted to ten (10) feet to <br />conform with the proposed amendments to the acdessory building regulations. <br /> <br />-299- <br /> <br /> <br />
