During the platting process in 2004, the Board of Adjustment granted Mr. Schaeffer a variance to <br />the street frontage requirements so that one home may be constructed on the property without the <br />need to extend 174th Avenue into the property. Access will continue to be from 174th Avenue <br />N.W. and the terms of the variance will be upheld. It is noted that a drainage and utility <br />easement is being dedicated on the final plat to protect the future right-of-way corridor for the <br />extension of 174th Avenue N.W. to the extent of Lot 1, the buildable portion of the plat. <br /> <br />The Cluster Ordinance requires a future urban development plan, which may be waived by <br />Council if only one lot is being platted. Staff is recommending waiving the resubdivision plan <br />requirement as one was provided during the platting process in 2004. The new cluster ordinance <br />states that all future streets, parks, trails, and utility easements should be platted as outlots, and ' <br />that this requirement may also be waived if only 1 lot is being platted. Staff recommends <br />waiving ~his requirement. <br /> <br />The park dedication, trail fees and stormwater management fees were addressed with the plat <br />process in 2004. No new lot is being created with this replat and no additional fees are due to the <br />City. <br /> <br />On April 7, 2005, the Planning Commission determined that the sketch plan was acceptable. <br /> <br />Recommendation: <br /> <br />City Staff recommends final plat approval. <br /> <br />Council Action: <br /> <br />Motion by Councilmember and seconded by Councilmember to adopt <br />Resolution #05-05- . granting final plat approval to Falconer's Ridge Second Addition <br />contingent upon compliance with the City Staff Review Letter dated May 5, 2005 and the <br />Developer entering into a Development Agreement with the City. <br /> <br />Review Checklist: <br />Community Development Director <br />Civil Engineer <br />City Attorney <br /> <br />CC: 05.24.05 <br /> <br />-314- <br /> <br /> <br />
