CASE #: <br /> <br />PROPOSED ORDINANCE TO AMEND THE ACCESSORY <br />STRUCTURE SECTION OF CITY CODE <br /> By: Zoning & Recycling Coordinator Chris Anderson <br /> <br />Back,round: <br /> <br />City Code currently prohibits the construction of split level and two-story accessory buildings. <br />Also, the maximum height of accessory buildings, which is either 16 or 22 feet, is based on the <br />size oF a parcel, with 2.5 acres or more necessary for the greater height. 'Additionally, the size of <br />accessory buildings is also based on the size of a parcel. However, all parcels 10.6 acres or <br />greater in size are all limited to the same amount of square footage for accessory buildings, <br />which is 5,664 square feet. Finally, the majority of the regulations for swimming pools and spas <br />are currently in Chapter 8 (Building & Housing) of City Code, yet mos.t_ are zoning related and <br />wottld be more appropriately located in Chapter 9 (Zoning & Subdivision of Land). <br /> <br />['he l¥llowing items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br /> <br />Existing Section 9.11.02 with deletions and additions proposed <br />Proposed ordinance to amend Sections 9.11.02 and 9.20.11 <br />Proposed ordinance to amend Section 8.21 <br />Draft Planning Commission meeting minutes dated May 5, 2005 <br /> <br />Observations: <br /> <br />Thc restriction on two-story and split-level detached accessory buildings would remain in'tact for <br />properties that are less than two (2) acres in size. However, with the proposed amendment, <br />properties that are two (2) acres or greater in size would now be eligible for a two-story <br />acces~'.;ory building through the conditional use permit process. <br /> <br />Both the exterior finish of accessory buildings and locating an accessory building nearer the front <br />property line than home are linked to a two (2) acre threshold, yet the height of. accessory <br />buildings is linked to a threshold of 2.5 acres...The proposed amendment would link the height of <br />accessory buildings to the same threshold of two (2) acres, resulting in a height restriction of <br />sixteen (16) feet for properties less than two (2) acres and .twenty-two (22) feet for properties that <br />two (2) acres or greater. <br /> <br />The proposed amendment would also create additional size categories for larger properties, <br />starting at ten (10) acres, which would allow for more square footage for accessory building <br />space. While larger amounts of square footage would be allowed, the proposed amendment <br />would also place a limit on the number df accessory buildings permitted on an individual <br />properi),. <br /> <br />Swimming pool and spa regulations are currently located in Chapter 8 (Building and Housing) of <br />City (;ode. However, many of the regulations are. related to zoning issues and thus, the proposed <br />amendment would incorporate these regulations into Chapter 9 (Zoning & Subdivision of Land). <br />Thc majority of these regulations would remain unchanged.
