modifications that are proposed include the revised definition of a pool (changing from 100
square feet of surface area to 200 square feet of surface area and two feet in depth) and a ten (10)
foot setback for pools from side and rear property lines.

Finally, certain structures are exempted from the building permit process such as accessory
structures 120 square feet or less, fences six (6) feet or less in height, swimming pools and spas
less than 5,000 gallons, and driveways. However, all of these types of structures must still
comply with zoning regulations. Thus, a zoning permit has been created and would be required
to help ensure that these types of structures are properly located on a property and'meet all other
zoning regulations.

The Planning Commission held a pubIic hearing on the most recent versions of these ordinance
amendments on May 5, 2005 and there were no verbal or written comments submitted.

Recommendation:

The Planning Commission, by virtue of a 5-1 vote, has recommended adoption of the proposed
ordinances.

City Council Action:

Motion by Councilmember and seconded by Councilmember
introduce ordinance #05- amending Section 9.11.02 (Accessory Structures)

to

-and-

Motion by Councitmember and secOnded by Councilmember
introduce ordinance #05- . amending Section 9.20.11 (R-1 Residential District)

to

-and-

Motion by Councilmember and seconded by Councilmember
introduce ordinance #05- amending Section 8.21 (Swimming Pool and Spa Permit).

¸to

Reviewed By:
Asst, Com.
