bigger than a typical development and the developer is paying for portions of regional roadway <br />improvements that other developers do not pay for. <br /> <br />Public Works Director Kapler requested direction from the Committee on how staff should <br />proceed with this. He noted typically parks are not included as a participating member of <br />assessments. With the two parkway roads involved with Town Center this would be a huge <br />element. <br /> <br />Chairperson Elvig suggested they may want this to go back before the Council to determine what <br />the secondary developer obligations are in Town Center. He noted it will also need to be <br />determined what the obligations will be of the Pact Charter School. <br /> <br />Assistant Public Works Director explained the Master Development Agreement is currently set up <br />that the City would assess for 50 percent of any improvements in Town Center. It is not set up <br />that the secondary or master developer put down an escrow to cover the sealcoat; the agreement <br />is silent on that issue. <br /> <br />Chairperson Elvig directed staff to look into the requirements according to the City's standard <br />ordinance for sealcoating in comparison to the requirements of the Master Development <br />Agreement, determining a dollar amount of the sealcoating requirements within five years. This <br />should be brought back before the Committee with some sense of urgency. The Council should <br />be made aware of this potential glitch when the first amendment to the Master Development <br />Agreement is discussed tonight. <br /> <br />No Committee action needed. <br /> <br />Case #2: Update on Removal of Hump on TH47 <br /> <br />Assistant Public Works Director Olson indicated staff met with MN/Dot staff on the afternoon of <br />February 11, 2005 and received an update on the plans to modify the profile of TH 47 south of <br />167th Avenue. MnDOT indicated they would be able to remove about two feet of the hump and <br />stay within the existing confines of the right-of-way. In the future they may be able to work with <br />the owner of the pumpkin patch to even further correct this issue. With the current plan there <br />would still be a hump there, but the top of a car would be able to be seen, allowing for a longer <br />reaction time. MnDOT would finance the improvements. <br /> <br />Mayor Gamec suggested the bypass line at the intersection of 167th Avenue be addressed when <br />the hump is being graded. <br /> <br />Assistant Public Works Director Olson explained MnDOT has the right-of-way necessary for the <br />grading of the hump. The bypass line would not likely be included in this contract, as it would <br />push the work into the next construction season. <br /> <br />Chairperson Elvig noted sewer and water may be installed in this area, and the street could be dug <br />up again shortly after this work is done. <br /> <br />Public Works Committee/February 15, 2005 <br /> Page 5 of 8 <br /> <br /> <br />
