S. 3021-22 <br />SEC. 1146. RESERVOIR SEDIMENT. <br />Section 215 of the Water Resources Development Act of 2000 <br />(33 U.S.C. 2326c) is amended— <br />(1) in subsection (a) — <br />(A) by striking "the date of enactment of the Water <br />Resources Development Act of 2016" and inserting "the <br />date of enactment of the Water Resources Development <br />Act of 2018"; and <br />(B) by striking "shall establish, using available funds, <br />a pilot program to accept" and inserting "shall, using avail- <br />able funds, accept"; <br />(2) in subsection (b)— <br />(A) in paragraph (2), by adding "and" at the end; <br />(B) in paragraph (3), by striking "; and" at the end <br />and inserting a period; and <br />(C) by striking paragraph (4); and <br />(3) by striking subsection (f) and inserting the following: <br />"(f) REPORT TO CONGRESS. —Not later than 3 years after the <br />date of enactment of the Water Resources Development Act of <br />2018, the Secretary shall submit to the Committee on Environment <br />and Public Works of the Senate and the Committee on Transpor- <br />tation and Infrastructure of the House of Representatives a report <br />describing the results of the program under this section.". <br />SEC. 1147. CLARIFICATION FOR INTEGRAL DETERMINATION. <br />Section 601(e)(5) of the Water Resources Development Act of <br />2000 (Public Law 106-541) is amended— <br />(1) in subparagraph (B)(i)— <br />(A) in subclause (II), by striking "; or" and inserting <br />a semicolon; and <br />(B) by inserting after subclause (III) the following: <br />"(IV) the credit is provided for work carried out <br />by the non -Federal sponsor in the implementation of <br />an authorized project implementation report, and such <br />work was defined in an agreement between the Sec- <br />retary and the non -Federal sponsor prior to the execu- <br />tion of such work; or <br />"(V) the credit is provided for any work carried <br />out by the non -Federal sponsor, as agreed to by the <br />District Commander and non -Federal sponsor in a writ- <br />ten agreement (which may include an electronic agree- <br />ment) prior to such work being carried out by the <br />non -Federal sponsor;"; <br />(2) in subparagraph (B), by amending clause (iii) to read <br />as follows: <br />"(iii) the Secretary determines that the work per- <br />formed by the non -Federal sponsor — <br />"(I) is integral to the project; and <br />"(II) was carried out in accordance with the <br />requirements of subchapter 4 of chapter 31, and <br />chapter 37, of title 40, United States Code."; <br />(3) by redesignating subparagraphs (C) through (E) as sub - <br />nova rrro nhc (I)l fh rn1i ran (Ti ) rocnonfixrol v• onnl <br />
