S. 3021-70 <br />to the Black Warrior River on the south side below the U.S. High- <br />way 43 bridge, including the south wall of the Old Oliver Lock, <br />and extending to the Corps' current recreation area, that the Sec- <br />retary determines are no longer required for operation and mainte- <br />nance of the Oliver Lock and Dam. <br />(h) GENERALLY APPLICABLE PROVISIONS.— <br />(1) SURVEY TO OBTAIN LEGAL DESCRIPTION. —The exact acre- <br />age and the legal description of any real property to be conveyed <br />under this section shall be determined by a survey that is <br />satisfactory to the Secretary. <br />(2) APPLICABILITY OF PROPERTY SCREENING PROVISIONS. — <br />Section 2696 of title 10, United States Code, shall not apply <br />to any conveyance under this section. <br />(3) ADDITIONAL TERMS AND CONDITIONS. —The Secretary <br />may require that any conveyance under this section be subject <br />to such additional terms and conditions as the Secretary con- <br />siders necessary and appropriate to protect the interests of <br />the United States. <br />(4) COSTS OF CONVEYANCE. —An entity to which a convey- <br />ance is made under this section shall be responsible for all <br />reasonable and necessary costs, including real estate trans- <br />action and environmental documentation costs, associated with <br />the conveyance. <br />(5) LIABILITY. —An entity to which a conveyance is made <br />under this section shall hold the United States harmless from <br />any liability with respect to activities carried out, on or after <br />the date of the conveyance, on real property conveyed. The <br />United States shall remain responsible for any liability with <br />respect to activities carried out, before such date, on the real <br />property conveyed. <br />SEC. 1332. REPORT ON FUTURE WATER RESOURCES DEVELOPMENT. <br />(a) PROGRAMMATIC MODIFICATION. —Section 7001 of the Water <br />Resources Reform and Development Act of 2014 (33 U.S.C. 2282d(a)) <br />is amended— <br />(1) in subsection (a) by adding at the end the following: <br />"(4) PROGRAMMATIC MODIFICATIONS. —Any programmatic <br />modification for an environmental infrastructure assistance pro- <br />gram."; <br />(2) in subsection (b)(1) by striking "studies and proposed <br />modifications to authorized water resources development <br />projects and feasibility studies" and inserting "studies, proposed <br />modifications to authorized water resources development <br />projects and feasibility studies, and proposed modifications for <br />an environmental infrastructure program"; <br />(3) by redesignating subsections (d), (e), and (f) as sub- <br />sections (e), (f), and (g), respectively; <br />(4) by inserting after subsection (c) the following: <br />"(d) PROGRAMMATIC MODIFICATIONS IN ANNUAL REPORT. —The <br />Secretary shall include in the annual report only proposed modifica- <br />tions for an environmental infrastructure assistance program that <br />have not been included in any previous annual report.
