S. 3021-71 <br />"(4) APPENDIX. — <br />"(A) IN GENERAL. —The Secretary shall include in the <br />annual report an appendix listing the proposals submitted <br />under subsection (b) that were not included in the annual <br />report under paragraph (1)(A) and a description of why <br />the Secretary determined that those proposals did not meet <br />the criteria for inclusion under such paragraph. <br />"(B) LIMITATION. —In carrying out the activities <br />described in this section— <br />"(i) the Secretary shall not include proposals in <br />the appendix of the annual report that otherwise meet <br />the criteria for inclusion in the annual report solely <br />on the basis of the Secretary's determination that the <br />proposal requires legislative changes to an authorized <br />water resources development project, feasibility study, <br />or environmental infrastructure program; and <br />"(ii) the Secretary shall not include proposals in <br />the appendix of the annual report that otherwise meet <br />the criteria for inclusion in the annual report solely <br />on the basis of a policy of the Secretary.". <br />(b) SAVINGS CLAUSE. —Notwithstanding the third sentence of <br />section 1001(b)(2) of the Water Resources Development Act of 1986 <br />(33 U.S.C. 579a(b)(2)), projects and separable elements of projects <br />identified in the fiscal year 2017 report prepared in accordance <br />with such section and submitted to Congress on December 15, <br />2016, shall not be deauthorized unless such projects and separable <br />elements meet the requirements of section 1301(b)(1)(A) of the <br />Water Resources Development Act of 2016 (130 Stat. 1687). <br />Subtitle D—Water Resources <br />Infrastructure <br />SEC. 1401. PROJECT AUTHORIZATIONS. <br />The following projects for water resources development and <br />conservation and other purposes, as identified in the reports titled <br />"Report to Congress on Future Water Resources Development" sub- <br />mitted to Congress on March 17, 2017, and February 5, 2018, <br />respectively, pursuant to section 7001 of the Water Resources <br />Reform and Development Act of 2014 (33 U.S.C. 2282d) or otherwise <br />reviewed by Congress are authorized to be carried out by the <br />Secretary substantially in accordance with the plans, and subject <br />to the conditions, described in the respective reports or decision <br />documents designated in this section: <br />(1) NAVIGATION.— <br />
