Councilmember Anderson noted the tobacco compliance check where 8 out of 18 failed. She <br />stated her support for monthly tobacco checks and indicated she has the same or stronger feelings <br />about liquor sales compliance. She stated that there is no excuse to sell liquor to minors, no <br />matter the number of stores in Ramsey or need to "survive." <br /> <br />Councilmember Hendriksen stated it was mentioned that a license could not be issued to <br />property where taxes are not paid and the application form indicates that if taxes are paid, a <br />document proving such needs to be submitted. He stated that a decision tonight seems to be <br />rather fundamental. <br /> <br />City Attorney Goodrich stated it appears the Council would like him to further study the issues <br />of distances and clustering. <br /> <br />Councilmember Anderson stated she would like those issues studied. <br /> <br />City Attorney Goodrich stated he will review these issues and provide a recommendation at the <br />next meeting. <br /> <br />Mayor Gamec noted that tabling consideration to the next meeting should not impact the <br />applicant's ability to open by May 1, 2001. <br /> <br />Motion by Councilmember Anderson, seconded by Councilmember Zimmerman, to table <br />consideration of an off-sale liquor license application for Mark D. and Teresa D. Callender, <br />d/b/a/Vintage Wine & Spirits. <br /> <br />Further discussion: Councilmember Zimmerman suggested the City Attorney advise if a <br />moratorium should be put into place until the study is completed. Mayor Gamec noted that, <br />perhaps, a moratorium should be considered tonight to prevent another liquor application prior to <br />the completion of the study. City Attorney Goodrich stated a moratorium could be acted on <br />tonight for a period of 90 days but he is unsure if it will impact the Callender application. <br />Councilmember Hendriksen asked if the Council needs a resolution in hand to initiate a <br />moratorium. City Attorney Goodrich stated he will have to research whether a resolution or <br />ordinance is needed for the moratorium and he will answer that question at the next meeting. He <br />recommended the Council consider a motion to place the moratorium tonight. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Anderson, Zimmerman, <br />Hendriksen, and Kurak. Voting No: None. <br /> <br />Mayor Gamec announced that this liquor application will be placed on the next Council agenda. <br /> <br />Motion by Councilmember Zimmerman, seconded by Councilmember Anderson, to place a <br />moratorium on acceptance of further .applications of off-sale liquor licenses for a period of 90 <br />days pending study of how many and where future off sale liquor license establishments shall be <br />located in the City of Ramsey. <br /> <br />City Council/March 13, 2001 <br /> Page 10 of 31 <br /> <br /> <br />
