Mayor Gamec replied that an easement would have to be granted to Mate to use the access. <br /> <br />Councilmember Hendriksen inquired if it would make sense to approve site plan contingent upon <br />resolving the access issue at a later date. <br /> <br />City Engineer Jankowski stated that staff could put together the costs of relocating Sunfish Lake <br />Court and bring them back for Council review. <br /> <br />Councilmember Anderson inquired if the buildings proposed by Mr. Sharp would be built in the <br />same location regardless of the location of the access. <br /> <br />Mr. Sharp stated that he is concerned about the economics of moving the street. <br /> <br />Mayor Gamec stated that he would prefer the County recommendation over moving Sunfish <br />Lake Court. <br /> <br />Councilmember Zimmerman stated that the cost of moving the utilities alone would cost <br />thousands of dollars. He stated that it would make sense if the street had not already been <br />constructed. <br /> <br />Motion by Councilmember Hendriksen, seconded by Councilmember Zimmerman, to approve <br />the proposed site plan for Sharp and Associates contingent upon compliance with City staff <br />review letter dated February 1, 2001, revised February 21, 2001, with the access from Sunfish <br />Lake Boulevard being located across from Sunfish Lake Court. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Zimmerman, <br />Anderson, and Kurak. Voting No: None. <br /> <br />Councilmember Hendriksen requested that staff research the requirement of using colored block. <br /> <br />Case #7: <br /> <br />Authorization for Sale of Property to Anoka County Community Action <br />Program (ACCAP) <br /> <br />City Administrator Norman stated that at the February 27, 2001 City Council meeting, the <br />Council introduced an ordinance to permit the sale of the City owned property at the intersection <br />of T.H. #47 and the soon to be built Sunwood Drive extension. This is approximately 11.2 acres, <br />which is the subject of the February 18, 1999 purchase agreement between the City and ACCAP. <br />ACCAP has commenced a lawsuit seeking specific performance of the purchase agreement <br />and/or damages from the City. Staff recommended adoption of the ordinance together with a <br />motion to authorize the City Administrator and the Mayor to execute the necessary documents to <br />close this transaction pursuant to the terms of the February 18, 1999 purchase agreement.
