Goodrich recommended that the motion be that the City Council received Mr. Thomson's legal <br />opinion dated March 23, 2001 and chose to take no further action. <br /> <br />Motion was amended by Mayor Gamec and Councilmember Kurak, to receive Mr. Thomson's <br />legal opinion and take no further action regarding the February 16, 2001 Charter Referendum <br />petition. <br /> <br />Further discussion: Councilmember Anderson stated that the density transition ordinance <br />introduced in December is bad law and bad planning. She stated that she is not opposed to <br />density transitioning in the City and is willing to work on the ordinance. Councilmember <br />Hendriksen implored Councilmember Anderson to vote no on the motion and follow up the <br />motion with a motion to table the matter for 30 days to allow the circulating committee to present <br />their side of the issue and allow the Council to draft a compromise rather than simply allowing <br />the circulating committee no legal input. Councilmember Zimmerman inquired if receiving the <br />report meant that the CounCil agreed with it. City Attorney Goodrich stated that a motion to <br />accept the opinion does not mean that they agree or disagree, but with the second half of the <br />current motion it means that the Council agrees with the opinion. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Anderson, and Kurak. Voting <br />No: Councilmember Hendriksen and Zimmerman. <br /> <br />Case #10: <br /> <br />Application for Off-Sale Intoxicating Liquor License Vintage Wine & <br />Spirits; Case of Mark and Teresa Callender <br /> <br />City Clerk Thieling stated that Mark D. Callender and Teresa D. Callender, d/b/a Vintage Wine <br />& Spirits have properly applied for an off-sale intoxicating liquor license at 14050 St. Francis <br />Boulevard NW, Suite B. A public hearing was held regarding the application during the March <br />13, 2001 City Council meeting, in which several questions were asked. A memo was presented <br />to the Council from the City Attorney addressing those issues. <br /> <br />Mayor Gamec requested that the issue of liquor licenses be placed as a work session discussion <br />item. <br /> <br />Motion by Mayor Gamec, seconded by Councilmember Kurak, to approve an off-sale liquor <br />license application for Mark D. and Teresa D. Callender, d/b/a Vintage Wine & Spirits. <br /> <br />Further discussion: Councilmember Zimmerman stated that there is going to be a new <br />subdivision at the Ramsey border in Anoka at the intersection of C.R. #116 and T.H. #47 which <br />could also include a liquor store. He inquired if there was anything that compelled the Council <br />to vote in the positive on the issue being that the applicant applied in good faith according to the <br />existing liquor law. City Attorney Goodrich stated that the Council could refuse to issue a liquor <br />license if there are articulated, factual reasons that are intended to promote the health, safety, and <br />welfare and/or morals of the resident of the City.
