Motion by Councilmember Hendriksen, seconded by Councilmember Anderson, to authorize the <br />Mayor and City Administrator to execute an Intercreditor Agreement with Bremer Business <br />Finance Corporation providing that the City subordinate its lien on the Systematic Refrigeration, <br />Inc. personal property except for the equipment purchased with the proceeds of the $300,000.00 <br />Promissory Note between the City and Systematic Refrigeration, Inc. and Mateski Properties, <br />LLC dated July 5, 2000, contingent upon all prior lenders subordinating their lien positions in the <br />Equipment to the City, and subject to the City Attorney's final approval as to form and <br />substance. <br /> <br />Motion carried. Voting Yes: Councilmembers Hendriksen, Anderson, Kurak, and Zimmerman. <br />Voting No: None. <br /> <br />Case'#5a: Density Transition Ordinance Discussion <br /> <br />Councilmember Hendriksen stated that the Council has had numerous meetings on the density <br />transition issue and some of the Councilmembers have indicated a desire to work on the <br />ordinance, but there has been a significant amount of time since any significant activity has taken <br />place. Presently the City is not protected against any future development and he felt that the <br />Council should decide formally on how they plan to proceed. <br /> <br />Councilmember Anderson stated that she would be in favor of scheduling a work session to <br />discuss the issue at length. <br /> <br />Councilmember Hendriksen noted that he was not suggesting that the Council attempt to work <br />on the ordinance during this meeting, but wanted to discuss how the Council was to going to <br />approach the issue. Does the Council want to create a committee to work on the ordinance, <br />involve further consulting efforts or bring in a negotiator. Since Density Transitioning seems to <br />be one of the sticking points in approving the Comprehensive Plan he felt that the Council should <br />develop something that they can all agree on. <br /> <br />Councilmember Zimmerman suggested that the Council work on the ordinance at work session <br />with a negotiator. <br /> <br />The Council reviewed different facilitators that may be able to assist the Council and directed <br />staff to select a facilitator and schedule a meeting. <br /> <br />Councilmember Kurak stated that she is uncomfortable with the fact that the Comprehensive <br />Plan is not being approved because of a density transition ordinance. She inquired if it was a <br />political issue and if density transitioning is something that is required as part of the <br />Comprehensive Plan. <br /> <br />City Council/April 10, 2001 <br /> Page 11 of 18 <br /> <br /> <br />
