accessory building that would be 18 feet two inches in height, which results in a two feet two <br />inch deviation from City Code. The applicant would like to exceed the 16 foot height restriction <br />in order to construct a detached accessory building that closely matches the height and width of <br />the existing attached garage. The applicant is proposing to construct a 1,080 square foot <br />detached accessory building and the attached garage is 580 square feet in size. The total <br />accessory building space would be 1,660 square feet, which would comply with City Code. The <br />detached accessory structure will be constructed on a floating concrete slab, will have ten foot <br />side walls, a 6/12 roof pitch, a 10 foot by 9 foot overhead door, and the exterior wall materials <br />will consist of tan vinyl siding. The accessory building will closely match the height of the <br />attached garage and will not exceed the height of the principal building. The applicant has stated <br />that the detached accessory building will be utilized for personal storage. The proposed detached <br />accessory building will be located in the rear yard approximately 60 feet south of the principal <br />dwelling. The proposed location exceeds the six foot side yard and five foot rear yard setbacks <br />established in the residential urban areas. The applicant is not proposing to install a driveway to <br />the detached building since the accessory building will be used mainly for storage and not an <br />active daily parking garage. The Planning Commission held a public hearing on April 3, 2001. <br />Subsequent to the Planning Commission meeting staff received a letter opposing the construction <br />of Mr. Hansen's accessory building. Ms. Schimmelman contacted staff regarding the letter she <br />submitted to the City, during the conversation it became apparent to staff that Mr. and Mrs. <br />Schimmelman were opposing construction of any accessory structure on Mr. Hansen's property <br />and not the conditional use permit request to exceed accessory building height. Staff explained <br />that City Code permits construction of accessory buildings on residential lots and Mr. Hansen <br />was not proposing to exceed the accessory building square footage standards. <br /> <br />Jeff Hansen, 6250 - 152nd Avenue NW, noted that he reviewed the neighborhood covenants from <br />Anoka County, and there are no restrictions on accessory buildings. <br /> <br />Motion by Councilmember Kurak, seconded by Mayor Gamec, to adopt Resolution #01-04-187 <br />adopting Findings of Fact # 0549 relating to Jeff Hansen's request for a conditional use permit to <br />exceed the accessory building height restriction. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Kurak, Anderson, Hendriksen, <br />and Zimmerman. Voting No: None. <br /> <br />Motion by Councilmember Kurak, seconded by Mayor Gamec, to adopt Resolution #01-04-188 <br />approving Jeff Hansen's request to exceed accessory building height restrictions based on the <br />findings of fact, and adopt a resolution declaring terms of same. <br /> <br />Motion carried.
