Case #3: <br /> <br />Request for Final Plat Review of Clemens Addition; Case of Vincent and <br />Evelyn Clemens <br /> <br />Community Development Director Frolik stated that Vincent and Evelyn Clemens were <br />requesting final plat approval for a minor subdivision to plat an existing lot into three urban-sized <br />lots. The subject property is located at the comer of Ebony Street NW and 137th Avenue NW in <br />the Riverside West subdivision. Vince and Evelyn Clemens originally proposed to develop their <br />one-acre lot into two urban sized lots. They brought forward a sketch plan showing two lots. <br />The Planning Commission reviewed the sketch plan and recommended approval of the <br />subdivision. After the Planning Commission meeting, staff discovered that the Clemens property <br />is within the Critical River and the Wild and Scenic River Overlay District. These districts <br />require 90 foot lot widths instead of the City minimum of 80 foot lot width. Both overly districts <br />require that the 90 foot lot width needs to be met at the street frontage and the front building line. <br />The Clemens have redrawn the plat to show a lot width of 90 feet from the street to the front yard <br />setback line; therefore, the plat as drawn meets the Critical River and Wild and Scenic River <br />Overlay District standards. After learning that their plat would have to change, the Clemens <br />decided to create another urban-sized lot on the northern part of their property. As the third lot <br />does not have City sewer and water serving the property at this time, the applicant will be <br />platting the northern lot as an outlot. Once City sewer and water reach the outlot, the owner will <br />need to re-plat the outlot to make it a buildable lot. The final plat submitted as part of this case <br />will need to be modified to show Lot 3, Block 1, as an outlot. There is a house on the western <br />part of the development property. After the platting, the existing house will be located on Lot 1, <br />Block 1 of the new plat. Lot 2, Block 1 would be a new buildable lot. The existing residence <br />already received City sewer and water and City services are stubbed to that area proposed to be <br />platted as Lot 2. The lots meet the minimum dimensional and area standards established for the <br />R1-U District. The existing homestead will be required to pay a sewer lateral charge consistent <br />with City policy. Lot 2 will be required to pay sewer and water trunk and lateral fees. When the <br />urban services were installed in Riverside West to facilitate development of Rivenwick, it was <br />agreed that the existing parcels in Riverside West would not be assessed for laterals until they <br />subdivided. The traffic generation analysis indicates that this subdivision will generate a <br />minimal impact to the surrounding streets in the area. The Park Commission reviewed the plat <br />on February 8, 2001, and recommended that the applicant pay the park dedication fee only for <br />Lot 2, Block 1 of $1,300 and the trail fee of $325.00. <br /> <br />Motion by Councilmember Anderson, seconded by Councilmember Hendriksen, to adopt <br />Resolution #01-04-189 granting final plat approval of Clemens Addition subject to Lot 3, Lot 1 <br />being shown as an outlot and compliance with City staff review letter dated April 20, 2001. <br /> <br />Further discussion: Councilmember Hendriksen inquired if a public hearing was required. <br />Community Development Director Frolik replied no, explaining that a public hearing is not <br />required for a minor subdivision. <br /> <br />Motion carried.
