The properties are within the MUSA, but
are currently zoned R-1 Rural Residential. In order to plat urban lots, the property must be zoned
R-1 Urban Residential.

City Administrator Norman stated that the City Council reviewed the rezoning request on
January 23, 2001. The Council referred the case to the Public Works Committee in order to
resolve a storm drainage easement issue that would cross the Pehlke property. During the Public
Works Committee, staff proposed a more comprehensive approach to the storm drainage issues
in the neighborhood as well as other infrastructure issues that would be affected by future
development. Staff worked closely with the Pehlkes and determined that more discussion would
be necessary prior to resolving all the issues in the neighborhood, however, it was further agreed
that the rezoning and plat process should proceed. The Pehlkes have agreed to sign a Letter of
Understanding, which states that the Pehlkes will continue to negotiate with the City to allow a
water drainage easement on their property.

Councilmember Kurak stated that when other people subdivide their property there is a plan that
has to be submitted showing future roads and it appeared as if 152"d could run on the northern
part of the Pehlke property. She inquired if there would be future discussion regarding that
roadway.

City Administrator Norman replied yes, but since the Pehlkes are willing to work with the City
they did not want to hold back the building of the house.

Councilmember Kurak stated that she wanted to make sure that the issue is addressed.

Councilmember Anderson stated that the Letter of Understanding is unclear of what is being
offered.

City Attorney Goodrich replied that the Letter of Understanding would only be signed by the
Pehlkes and not something that the City would be committing to.

City Council/April 24, 2001
