4. Upgrade width and roadway surface of Old CSAH 5 <br /> <br />Thc landscaping plan is acceptable. <br /> <br />The grading and drainage plan will need to be revised in accordance with the staff review letter. <br /> <br />The property contains several wetlands. The developer has agreed to establish a "No Mow" zone along <br />the wetlands. This will help future residents to know where they need to stop establishing a manicured <br />lawn. Staff is also requesting that the developer plant appropriate seeding specifications within a portion <br />of the no mow zone to further establish and protect the wetland areas. <br /> <br />The proposed plat was reviewed for park dedication and trail requirements by the Park Commission at <br />their April 14, 2005 meeting. The Park Commission recommended that park dedication and trail fees be <br />satisfied through a cash payment. The preliminary plat is providing a bituminous trail along County <br />Road 5 and is providing a pedestrian connection within the plat from Quicksilver Circle to the proposed <br />trail along County Road 5. The proposed trail configuration complies with the desires and <br />recommendation established by the Park and Recreation Commission. <br /> <br />~l'he Planning Commission held a public hearing and reviewed the preliminary plat and site plan on April <br />7, 2005. During the public hearing, several residents stated their opposition to the proposed <br />devel, opment. <br /> <br />Phmning Commission Recommendation: <br /> <br />The Planning Commission recommended denial of the preliminary plat and site plan based on an <br />inappropriate use of PUD, utilization of the townhomes, Potassium Street unresolved and crowding of <br />townhome units l-14. This motion passed on a 3-2 vote with one member abstaining. An earlier motion <br />to approve the above failed on a 3-3 tie vote. <br /> <br />Observations Continued: <br /> <br />Subscqucnt to the Planning Commission meeting, the applicant, City staff, and the City Attorney met to <br />discuss the outstanding issue of Potassium Street. Staff asked Shade Tree to look at ways to shift <br />Potassium Street to the west. They submitted a revised site plan that shows the road being shifted along <br />their property line and then providing a 25 foot easement solely within their property to allow for <br />adequate snow storage area. Generally speaking, this would allow the ability to save a significant amount <br />of trees that would have otherwise been removed to .facilitate the construction of Potassium Street down <br />the center of the 60 foot right of way. <br /> <br />On May 10, 2005, the City Council reviewed and tabled action on the plat and site plan due to <br />unresolved issues related to Potassium Street. The City Council directed staff to attempt to contact all <br />property owners in addition t o those referenced above, affected by the Potassium Street right-of-way <br />acquisition. Those property owners are Terry and Mary Lamont, David and Jean Mott, and Milt <br />Weichelt. Staff sent letters to the property owners and met with them on May 23 and June 1, <br />respectively. None of these property owners are in favor of the project. The parties do reluctantly agree <br />that il' Potassium Street mus'tbe upgraded, that its' right-of-way be split 33 feet on the Shadetree Property <br />and 33 feet on their property. The Lamonts seem to be most directly affected by the taking as the present <br />plan would require removal of significant' natural screening, including trees on their property and <br />possibly affect their on-site sewage system. <br /> <br /> <br />
