Chairperson Nixt asked if Mr. Gordon was saying the map is not complete. He asked how they <br />bridge the gap between the wetlands that are not on the map with the ordinance. <br /> <br />Commissioner Johnson indicated he takes exception with the ordinance saying the City will <br />inventory the wetlands. He stated the City does not need an ordinance to do what they need to <br />do. <br /> <br />Mr. (iordon indicated thc wetland conservation act puts everyone on notice that if there is a <br />wetland there arc certain things you need to do. <br /> <br />Commissioner Johnson indicated if the ordinance says any property undertaking development in <br />thc city has to comply with the ordinance it would be better. <br /> <br />Mr. Gordon stated that is what the ordinance says. <br /> <br />missioner Johnson indicated it needs to be more straightforward. <br /> <br />Chairperson Nixt commented that he assumes they will cross-reference this with the subdivision <br />and zoning ordinances. <br /> <br />Mr. Gordon agreed that it would be, and it states that in 9.26.05. <br /> <br />Commissioner Johnson commented that it does not say if you are subdividing a lot after this <br />ordinance is in effect you have to submit this information. <br /> <br />Mr. Gordon stated that is almost too basic; you have to do it according to the Wetland <br />Conservation Act. <br /> <br />Chairperson Nixt agreed it needs to be said, specifying after the effective date of the ordinance. <br />1 lc statcd what this will leave out is platted lots with no currently building permit. <br /> <br />Mr. Gordon indicated there are triggered events where this would go into effect, and would <br />include platted lots that have not been developed. He stated this goes down to the level of <br />grading, so if' you need a grading permit you would have to get a wetland evaluation. He added <br />that is really the only retroactive trigger for lots of record. He stated trying to do this <br />retroactively on lots created five years ago is challenging. He indicated the Environmental Policy <br />Task Force proposed an educational process to teach those landowners the implications of <br />development. <br /> <br />Chairperson Nixt called for a short recess at 9:43 p.m. The meeting resumed at 9:47 p.m. <br /> <br />Commissioner Johnson asked if section 9.26.02 Subd 2 is necessary. <br /> <br />Mt'.
