Chairperson Nixt asked if Mr. Gordon was saying the map is not complete. He asked how they
bridge the gap between the wetlands that are not on the map with the ordinance.

Commissioner Johnson indicated he takes exception with the ordinance saying the City will
inventory the wetlands. He stated the City does not need an ordinance to do what they need to
do.

Mr. (iordon indicated thc wetland conservation act puts everyone on notice that if there is a
wetland there arc certain things you need to do.

Commissioner Johnson indicated if the ordinance says any property undertaking development in
thc city has to comply with the ordinance it would be better.

Mr. Gordon stated that is what the ordinance says.

missioner Johnson indicated it needs to be more straightforward.

Chairperson Nixt commented that he assumes they will cross-reference this with the subdivision
and zoning ordinances.

Mr. Gordon agreed that it would be, and it states that in 9.26.05.

Commissioner Johnson commented that it does not say if you are subdividing a lot after this
ordinance is in effect you have to submit this information.

Mr. Gordon stated that is almost too basic; you have to do it according to the Wetland
Conservation Act.

Chairperson Nixt agreed it needs to be said, specifying after the effective date of the ordinance.
1 lc statcd what this will leave out is platted lots with no currently building permit.

Mr. Gordon indicated there are triggered events where this would go into effect, and would
include platted lots that have not been developed. He stated this goes down to the level of
grading, so if' you need a grading permit you would have to get a wetland evaluation. He added
that is really the only retroactive trigger for lots of record. He stated trying to do this
retroactively on lots created five years ago is challenging. He indicated the Environmental Policy
Task Force proposed an educational process to teach those landowners the implications of
development.

Chairperson Nixt called for a short recess at 9:43 p.m. The meeting resumed at 9:47 p.m.

Commissioner Johnson asked if section 9.26.02 Subd 2 is necessary.

Mt'. Gordon indicated it is necessary, but maybe is more reflective in the findings and intentions
section.

Planning Commission/April 21, 2005
