Casc #11: <br /> <br />Request for a Conditional Use Permit for an Oversized Accessory Building; <br />Case of James and Cheri Waller <br /> <br />Community Development Director Trudgeon stated the City has received an application from <br />James and Cheri Waller for a conditional use permit to exceed the maximum allowable square <br />footage for accessory buildings on properties between 14,880 and 43,559 square feet as <br />established in City Code on the property located at 17937 Fluorine St NW. He explained the <br />subject property is approximately 0.85 acres (37,168 square feet) in size and is located outside <br />the Metropolitan Urban Service Area (MUSA). According to City Code, the property is eligible <br />for 1,488 square feet of accessory building space. The proposed building will be 1,120 square <br />feet in size. Combined with the existing attached garage of 528 square feet, the applicant would <br />have 1,648 square feet in accessory building space. This results in an overage of 160 square feet. <br />The applicant would like to exceed the size restriction in order to construct a detached accessory <br />building that would accommodate the storage of private use vehicles and equipment. <br /> <br />Community Development Director Trudgeon explained the proposed accessory building will be <br />located in the rear yard, and will exceed all setbacks established in the R-1 Rural Developing <br />District. The exterior finish of the building will match that of the home and the building will not <br />exceed the 16-foot mean gable roof height restriction. Furthermore, the sidewall height of the <br />building will be restricted to 10 feet to conform with the proposed amendments to the accessory <br />building regulations. <br /> <br />Community Development Director Trudgeon stated the Planning Commission conducted a <br />public hearing and reviewed the request for a conditional use permit on May 5, 2005. There was <br />no public input at the public hearing. The Planning Commission recommended that City Council <br />approve the request for a Conditional Use Permit. <br /> <br />Councihnember Elvig asked if the applicant has intentions of operating a home occupation. <br /> <br />James Waller, applicant, responded in the negative and indicated the building will just be used <br />for storage. <br /> <br />Motion by Councilmember Cook, seconded by Councilmember Olson, to adopt Resolution//05- <br />05-148 adopting Findings of Fact #0721 relating to James and Cheri Waller's request for a <br />conditional use permit for an oversized accessory building. <br /> <br />Motion carried. Voting Yes: Mayor Pro Tem Elvig, Councilmembers Cook, Olson, Jeffrey, <br />Pearson, and Strommen. Voting No: None. Absent: Mayor Gamec. <br /> <br />Motion by Councilmember Cook, seconded by Councilmember Pearson, to adopt Resolution <br />#05-05-149 approving James and Cheri Waller's request for an oversized accessory building <br />based on the findings of fact, and adopt a resolution declaring terms of same. <br /> <br />Motion carried. Voting Yes: Mayor Pro Tern Elvig, Councilmembers Cook, Pearson, Jeffrey, <br />Olson, and Strommen. Voting No: None.
