of 5,867 square feet. This is a 100 square foot reduction in accessory building area on the <br />property; however, the number of buildings will remain at ten. Three of the accessory structures <br />consist of cemented in wood poles with a metal panel roof. It is staff's opinion that these <br />structures could easily be converted into structures with walls and, therefore, these structures <br />count toward the allowable accessory building square footage restrictions. The Planning <br />Commission held a public hearing on May 1, 2001. During the public hearing, Mr. Hinn stated <br />the he lived directly south of Mr. Stickney and did not have any objection to Mr. Stickney's <br />conditional use permit request. The Planning Commission recommended approval of the <br />conditional use permit with the condition that Mr. Stickney and any subsequent owners agree not <br />to construct any more accessory buildings on the property. <br /> <br />Councilmember Anderson inquired if since the property is currently zoned R-IR and the <br />property is developed in the future with the conditional use permit staying with the land, could <br />the City have a problem. <br /> <br />Community Development Director Frolik replied that the structures could easily be removed <br />from the property if it were developed. <br /> <br />Councilmember Anderson inquired as to how the City can issue a permit to replace an illegal <br />building. <br /> <br />Community Development Director Frolik replied that he needs the conditional use permit to re- <br />build the building that collapsed. <br /> <br />Councilmember Anderson stated that she is concerned that they are committing to more than just <br />re-building a building. <br /> <br />Mayor Gamec replied that when the property is subdivided the Council could request that the <br />buildings be removed. <br /> <br />Councilmember Anderson stated that the conditional use permit runs with the land. <br /> <br />Motion by Councilmember Zimmerman, seconded by Councilmember Hendriksen, to adopt <br />Resolution #01-05-209 Findings of Fact #0552 relating to Mr. Stickney's request for a <br />conditional use permit to exceed the number of accessory buildings on a property and the <br />accessory building square footage restrictions established in City Code. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Zimmerman, Hendriksen, <br />Anderson, and Kurak. Voting No: None. <br /> <br />Motion by Councilmember Hendriksen, seconded by Councilmember Zimmerman, to adopt <br />Resolution #01-05-210 approving Mr. Stickney's request for a conditional use permit to exceed <br />the number of accessory buildings on a property and the accessory building square footage <br /> <br />City Council/May 22, 2001 <br />Page 15 of 23 <br /> <br /> <br />
