compliance with City staff review letter dated April 27, 2001, revised May 18, 2001, and Amcor <br />Precast obtaining a variance to the building height and/or the City Council resolving the fire <br />suppression issue. The Planning Commission also recommended that the City Council include <br />an aerial ladder truck in the 2002 Capital Improvement Budget. <br /> <br />Councilmember Anderson inquired as to why the berming issue has not been resolved. <br /> <br />Mr. Miller replied that there was some misunderstandings in regards to the height and size of the <br />berm. Everyone now has an understanding of what is required and that is being revised. <br /> <br />Councilmember Hendriksen stated that if Amcor is committing to screening consistent with Bury <br />and Carlson he will have no problem. <br /> <br />Motion by Councilmember Hendriksen, seconded by Councilmember Kurak, to approve the <br />proposed site plan for Amcor Precast contingent upon compliance with City Staff review letter <br />dated April 27, 2001, revised May 18, 2001. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Kurak, Anderson, <br />and Zimmerman. Voting No: None. <br /> <br />Case #6: <br /> <br />Request for a Conditional Use Permit to Exceed Accessory Structure <br />Restrictions; Case of Mr. Stickney <br /> <br />Community Development Director Frolik stated that the City received an application from Mr. <br />Stickney requesting a conditional use permit to exceed the detached accessory building square <br />footage restriction and the maximum number of accessory buildings allowed on the property <br />located at 7956 - 173rd Avenue NW. The subject property is approximately 5.1 acres in size and <br />is zoned R-1R Rural Residential. On a 5.1 acre parcel, City Code allows a maximum of 3,264 <br />square feet of detached accessory building space and a maximum of three accessory buildings on <br />the property. The applicant currently has ten accessory buildings on the property and a total <br />accessory building area of 5,967 square feet. Staff met with Mr. Stickney on Tuesday, April 24, <br />2001. They walked the property in order to get a better understanding of where the accessory <br />buildings are located and what the accessory buildings are being used for. Staff determined that <br />the number and size of the structures does not diminish the use and aesthetics of the property. <br />Staff also observed that Mr. Stickney uses the accessory buildings for cars that he collects and <br />other various hobby equipment and materials that he works on. Mr. Stickney would like to <br />replace an existing 40 x 40 (1,600 square feet) accessory building with a 50 x 30 (1,500 square <br />feet) accessory building. During the snowy winter months, the roof of the 1,600 square foot <br />accessory building caved in and, as a result, it will need to be removed from the property. The <br />existing 1,600 square feet accessory building contains storage of vehicles and other <br />miscellaneous hobby items. Mr. Stickney will move these items into the proposed 1,500 square <br />foot accessory building. If Mr. Stickney replaced the 1,600 square foot accessory building with <br />a 1,500 square foot accessory building, the property would contain a total accessory building area <br /> <br />City Council/May 22, 2001 <br />Page 14 of 23 <br /> <br /> <br />
