space allowed on his property at 14490 Bowers Drive NW. The subject property is <br />approximately .7 acres in size and is zoned R~I Rural Residential. On a .7 acre parcel, City Code <br />allows a maximum of 1,488 square feet of accessory structure space. Accessory structures <br />include all attached and detached garages and outbuildings in excess of 120 square feet in size. <br />(Structures 120 square feet and less in size do not require a building permit and, therefore, are not <br />considered permanent structures and do not count against the total amount of accessory structure <br />space allowed on a property.) The Davis' have a 576 square foot attached garage and a 120 <br />square foot garden shed. Reducing the 1,488 restriction by 576 square feet results in an <br />accessory structure allowance of 912 square feet remaining on the property. Mr. Davis is <br />proposing to build a 960 square foot (24'x40') detached garage for the storage of personal <br />property. This proposal results in a 48 square foot overage in the amount of accessory structure <br />space allowed on the property. Similar permits have been granted in the past. The Planning <br />Commission conducted the public heating on June 5 and there were no written or verbal <br />comments submitted. The request is minimal and the Planning Commission is recommending <br />approval of the 48 square foot overage. <br /> <br />Motion by Councilmember Hendriksen, seconded by Councilmember Zimmerman, to adopt <br />Resolution #01-06-234 adopting Findings of Fact #0559 relating to Mr. Davis' request for a <br />conditional use permit to exceed the amount of accessory structure space allowed on the subject <br />property. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Zimmerman, <br />Anderson, and Kurak. Voting No: None. <br /> <br />Motion by Councilmember Zimmerman, seconded by Councilmember Kurak, to approve Mr. <br />Davis' request for a conditional use permit to exceed the amount of accessory structure space <br />allowed on the property, based on the findings of fact, and adopt Resolution #01-06-235 <br />declaring terms of same. <br /> <br />Motion carried. Voting No: None. <br /> <br />Case #4: <br /> <br />Request for an Interim Use Permit for Outdoor Paintball Activities; Case of <br />Diehard Paintball <br /> <br />Community Development Assistant Wald stated that the City has received a request for an <br />interim use permit from Diehard Paintball to establish an outdoor paintball course on the <br />property located at 14622 Ferret Street. The property has been used in the past several years for <br />various outdoor recreational activities. The City granted a conditional use permit in 1988 for the <br />go-cart track, bumper boats, and the miniature golf course. The conditional use permit was <br />amended in 1994 to include batting cages and a driving range. The property owner has not been <br />operating any recreational activities on the parcel for several years. Brian Gower is proposing to <br />lease the subject property from KRH Land LLC to facilitate a paintball business.
