required conditional use permits to be obtained for outdoor recreational activities in any district. <br />However, due to the close proximity of this parcel to the opportunity site (smart growth site) and <br />the parcel being designated for mixed use in the March 2001 draft comprehensive plan, Staff is <br />suggesting that the application be processed as an interim use permit. City Code states that <br />interim use permit can be in effect for a maximum of 5 years. Providing a 5-year cap on the <br />recreational use request will allow the City the time needed to plan for any permanent mixed-use <br />development that best suits this site. The Applicant is aware of the interim use permit 5-year <br />expiration date and is supportive of receiving an interim use permit instead of a conditional use <br />permit. The applicant is proposing to utilize the existing infrastructure, which consists of a small <br />retail store and an accessory building. The accessory building will facilitate storage of paintball <br />equipment and the retail building will be an area for people to register and purchase any paintball <br />supplies or equipment. In the future, Diehard Paintball may desire to utilize the existing <br />miniature golf course since it is still in great condition. Diehard Paintball will be utilizing the <br />existing parking lot which should provide enough parking spaces for the number of customers <br />projected. The applicant is not proposing to construct any permanent structures. The site plan <br />indicates that the paintball course will consist of various barricades that will be constructed out <br />of wood and pallets. It is Staff's understanding that there will not be any change to the existing <br />grade. The paintball courses will need to be changed frequently to provide variety to customers <br />and, therefore, constructing permanent structures will not provide Diehard Paintball the <br />flexibility they desire for their customers. The applicant is proposing to have business hours of <br />10:00am - 10:00pm Monday thru Friday, 8:00am - 10:00pm Saturday and 12:00pm - 10:00pm <br />on Sunday. Brian is estimating approximately 50 - 75 customers Monday thru Friday and 75 - <br />100 Saturday and Sunday. Before any customers can set foot onto the outdoor paintball course, <br />they must watch a safety video and be issued a safety certification card. The City granted a <br />conditional use permit to Diamonds Sports Bar for a paintball course on their property. The <br />Planning Commission reviewed the interim use permit request and held a public hearing on June <br />5, 2001. There was no public comment during the public hearing The Planning Commission <br />recommended approval of the interim use permit request to facilitate an outdoor paintball course. <br /> <br />Councilmember Hendriksen inquired as to how much parking will be on the site. <br /> <br />Community Development Assistant Wald replied that approximately 30 cars could park at the <br />site at one time. <br /> <br />Councilmember Anderson inquired if safety equipment will be required. <br /> <br />Brian Gower, Diehard Paintball, replied that people will be required to wear facial masks that <br />cover the entire face and side of the head. If a mask is removed they will be asked to leave. <br /> <br />Councilmember Anderson inquired as to how they were going to contain the operation. <br /> <br />Mr. Gower replied that there is enough property that they do not need a fence.
