Councilmember Anderson expressed concern that the site will look like a junk yard with using <br />pallets, tire, etc. <br /> <br />Mr. Gower replied that the pallets, and tires will be used to form walls and barriers. <br /> <br />Councilmember Anderson inquired as to how the City will know, if they are in compliance with <br />the conditional use permit. <br /> <br />Community Development Assistant Wald replied that the City could do an inspection each year. <br /> <br />Councilmember Anderson stated that the City would need to have some standards to review in <br />order to determine compliance. <br /> <br />City Attorney Goodrich noted that the Conditional Use Permit does control hours of operation, <br />does not permit any permanent structures on the site, requires a substantial public liability policy <br />be in place, sets noise level standards, and the City reserves the right to revoke the permit if the <br />City determines the health, safety and welfare of the citizens or customers is impacted. <br /> <br />Councilmember Anderson stated that the permit prohibits the permittee from having liquor <br />without a permit from the City, but questioned if that included 3.2 beer. <br /> <br />City Attorney Goodrich replied that it does' include 3.2 beer, but they could amend the permit so <br />that it clearly states that. <br /> <br />Mr. Gower noted that he will not permit any alcoholic beverages on the site. <br /> <br />Councilmember Hendriksen expressed concem with the size of the parking area. He felt that the <br />Conditional Use Permit should include something that prohibits cars from being parked <br />everywhere. <br /> <br />City Attorney Goodrich recommended including the following language in the Conditional Use <br />Permit "That the permittee agrees that there will not be any off-street parking. <br /> <br />Motion by Councilmember Zimmerman, seconded by Councilmember Kurak, to adopt <br />Resolution #01-06-236 adopting Findings of Fact #0560 relating to the request for an interim use <br />permit to facilitate an outdoor paintball course. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Zimmerman, Kurak, Anderson, <br />and Hendriksen. Voting No: None. <br /> <br />Motion by Councilmember Hendriksen, seconded by Councilmember Kurak, to adopt Resolution <br />#237 approving the request from Diehard Paintball for an interim use permit to facilitate an <br />outdoor paintball course based on Findings of Fact #0560 and adopting a resolution declaring the <br /> <br />City Council/June 26, 2001 <br /> Page 8 of 28 <br /> <br /> <br />
