COUNCIL BUSINESS <br /> <br />Case #1: <br /> <br />Review Status of Conditional Use Permit Compliance; Case of Danny's <br />Tranny's Aluminum Processing, Inc. <br /> <br />Mayor Gamec closed the regular portion of the City Council meeting at 7:16 p.m. in order to <br />conduct a public hearing. <br /> <br />Public Hearing <br /> <br />Mayor Gamec called the public hearing back to order at 7:16 p.m. <br /> <br />Presentation <br /> <br />City Attorney Goodrich stated that in 1989, the City of Ramsey issued a conditional use permit <br />to Dan Karst for an aluminum processing facility on Lot 1, Block 4, Gateway North Industrial <br />Park Plat 2 (14050 Basalt Street NW). In 1990, the City Council approved amending the <br />conditional use permit to permit the addition of a second melt furnace to the facility. In 1993, <br />the City Council amended the conditional use permit to allow for disassembly of engines and <br />transmissions on the site. On May 8, 2001, the City Council reviewed a historical account of the <br />administration of the permit and directed City staff to initiate the proper procedures to consider <br />revocation of the permit. City staff sent a letter to Mr. Karst identifying several violations of <br />permit conditions and allocated 30 days (until June 23) to correct the violations. A public <br />hearing was scheduled and properly advertised for June 26, 2001, to take public comment, <br />review the status of the conditional use permit compliance, and consider revocation of the permit. <br />On June 26, 2001, the City Council called the public hearing to order and, per staff's request, <br />convened the public hearing to July 10, 2001, and no further action was taken. Since that time, a <br />letter dated July 10, 2001, was received from Harry E. Gallaher, Lockridge Grindal Nauen <br />P.L.L.P., which stated the following: "We represent Danny's Aluminum Processing, Inc. and its <br />owner, Daniel Karst, and are writing to you to request that the City of Ramsey cancel the above- <br />referenced Conditional Use Permit as Mr. Karst and Danny's Aluminum Processing, Inc. no <br />longer own the real property for which the Conditional Use Permit was issued nor operate the <br />business located on the property. The business operations and real property have been sold to <br />Saint Paul Terminals, Inc., which we understand has been issued its own conditional use permit. <br />Please provide me with a record indicating that the City has granted our client's request to cancel <br />the permit." Based on the letter that was received, the City Attorney recommended that the <br />Council close the public hearing and take action to accept the request for a voluntary revocation <br />of the conditional use permit. <br /> <br />Citizen Input <br /> <br />There was none. <br /> <br />City Council/July 10, 2001 <br /> Page 4 of 14 <br /> <br /> <br />
