Motion by Councilmember Hendriksen, seconded by Councilmember Kurak, to close the public <br />hearing. <br /> <br />Motion carried. Voting No: None. <br /> <br />The public hearing closed at 7:19 p.m. <br /> <br />Council Business <br /> <br />Mayor Gamec called the regular City Council meeting back to order at 7:19 p.m. <br /> <br />Motion by Councilmember Anderson, seconded by Councilmember Hendriksen, to recognize the <br />acceptance of the letter dated July 10, 2001, from Harry E. Gallaher, Lockridge, Grindal, Nauen <br />P.L.L.P., regarding Danny's Aluminum Processing, Inc. Conditional Use Permit issued by <br />Resolution # 93-03-033, and based on the said letter terminating the Conditional Use Permit. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Anderson, Hendriksen, Kurak, <br />and Zimmerman. Voting No: None. <br /> <br />Case #2: Authorize Settlement Agreement with Vasseur Right-of-Way Acquisition <br /> <br />City Attorney Goodrich stated that the City has been in negotiations with acquisition of right-of- <br />way property for construction of Alpine Pine Drive extension between Variolite Street and <br />Armstrong Boulevard. The City Attorney and the City Administrator met with Mr. Vasseur and <br />his Attorney on June 28, 2001, and reached a tentative agreement during that meeting. Staff <br />believes that the settlement to purchase the property at the price of $84,000 will be complete <br />pending final authorization by the landowners and their Attorney. If the Council approves of the <br />settlement agreement the City will eliminate approximately $10,000 in legal fees. <br /> <br />Motion by Councilmember Kurak, seconded by Councilmember Hendriksen, to authorize the <br />City Attorney and City staff to make payment to Mr. Vasseur in the amount of $84,000 for right- <br />of-way acquisition. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Kurak, Hendriksen, Anderson, <br />and Zimmerman. Voting No: None. <br /> <br />Case #3: Consider Amendments to City's Youth Access to Tobacco Ordinance <br /> <br />Police Chief Gustafson stated that staff finds it is necessary to amend the City's "Youth Access to <br />Tobacco" ordinance in three areas. These include codifying the ordinance in Chapter 7 of the City <br /> <br />City Council/July 10, 2001 <br /> Page 5 of 14 <br /> <br /> <br />
