Code, requiring mandatory education for licensees and clerks and exempting exclusive tobacco <br />stores from the prohibition of open displays of tobacco products. They presented the "rough draft" <br />ordinance for discussion only. They were looking for Council comment, after which staff would <br />prepare a final ordinance for introduction and then adoption. <br /> <br />Councilmember Kurak inquired if the licensee would have to participate in the seminar every <br />year. <br /> <br />Police Chief Gustafson replied yes, explaining then it would keep them informed if there were <br />any changes made to the ordinance as well as if management changes then the new managers <br />would be adequately educated. <br /> <br />Councilmember Kurak inquired if there would be any requirement for people working in the <br />establishment. <br /> <br />Police Chief Gustafson replied that section d of the ordinance would require that the store itself <br />familiarize its clerks with the City's ordinance and State laws, and further keep such evidence of <br />training their clerks for the City to inspect. <br /> <br />Councilmember Kurak inquired as to how the compliance inspections have been going. <br /> <br />Police Chief Gustafson replied that there were three failures in June, but only one in May. <br /> <br />Councilmember Hendriksen inquired as to how staffplans on delivering the two-hour course. <br /> <br />Police Chief Gustafson explained that the course would be held in the training center at the Fire <br />Station and the licensee or designee would be required to attend. The course would cover some <br />of the basics of the City ordinance and what the penalties are for non-compliance <br /> <br />Councilmember Hendriksen inquired as to how often the course would be offered. <br /> <br />Police Chief Gustafson replied that staff felt that three seminars throughout the year would be <br />reasonable. <br /> <br />Councilmember Hendriksen inquired as to how the cost of the seminars would be covered. <br /> <br />Police Chief Gustafson replied that the fines collected for non-compliance can be used to offset <br />the costs as well as the City received a $46,000 grant from the State to administer such programs. <br />The grant will cover the start-up costs, but after that the City would have to cover the costs. The <br />City could also use the $125 license fee to offset some of the costs as well. <br /> <br />Councilmember Hendriksen expressed concern with the City holding multiple sessions and using <br />all of the staff. He felt that the City should be recovering the cost of the seminars.
