Councilmember Kurak inquired if the City charges a fee to renew the license. <br /> <br />City Attorney Goodrich replied yes, noting that the City charges a $125.00 renewal fee. <br /> <br />Councilmember Hendriksen stated that there was a reason for that fee, which did not include the <br />training. <br /> <br />Police Chief Gustafson stated that the City is trying to deny youth access to the tobacco and <br />emphasized that the City needs to move forward with the ordinance even it is done at a deficit, <br />because it is the right thing to do. <br /> <br />City Attorney Goodrich noted that the Council could look at increasing the license fee since the <br />Council will be reviewing the budget soon. <br /> <br />Police Chief Gustafson stated that he would bring the issue back for Council consideration <br />including the cost of the seminars and ways to offset the costs. <br /> <br />Case #4: Consider Settlement Agreement with ACCAP <br /> <br />City Administrator Norman stated that the City had a litigation suit over nonperformance of a <br />purchase agreement brought against it by Anoka County Community Action Program (ACCAP) <br />which was initiated on December 27, 2000. The City Council agreed to exercise the purchase <br />agreement of February 18, 1999, during their regular meeting of February 27, 2001. <br />Complications that resulted from wetland mitigation caused the City Council to meet in closed <br />session to discuss the matter with the Attorney. Based upon the discussion with the Attorney <br />during the closed session meeting on July 5, and a privileged attorney/client session, the <br />settlement agreement is now presented for formal acceptance. Mr. Norman noted that ACCAP <br />had requested one change to the settlement agreement, which would allow for one single-family <br />unit group home. <br /> <br />City Attorney Goodrich noted that State law states that a residential property cmmot be barred <br />from becoming a group home. He stated that he did not think that what ACCAP had requested <br />gave them any additional rights. <br /> <br />Councilmember Kurak inquired if ACCAP was asking for anything that exceeded the existing <br />zoning. <br /> <br />City Attorney Goodrich replied no. <br /> <br />Councilmember Kurak inquired as to why the City has to stipulate any number of units if <br />ACCAP will be required to follow the current zoning. <br /> <br />City Council/July 10, 2001 <br /> Page 7 of 14 <br /> <br /> <br />
