Councilmember Kurak inquired if the City charges a fee to renew the license.

City Attorney Goodrich replied yes, noting that the City charges a $125.00 renewal fee.

Councilmember Hendriksen stated that there was a reason for that fee, which did not include the
training.

Police Chief Gustafson stated that the City is trying to deny youth access to the tobacco and
emphasized that the City needs to move forward with the ordinance even it is done at a deficit,
because it is the right thing to do.

City Attorney Goodrich noted that the Council could look at increasing the license fee since the
Council will be reviewing the budget soon.

Police Chief Gustafson stated that he would bring the issue back for Council consideration
including the cost of the seminars and ways to offset the costs.

Case #4: Consider Settlement Agreement with ACCAP

City Administrator Norman stated that the City had a litigation suit over nonperformance of a
purchase agreement brought against it by Anoka County Community Action Program (ACCAP)
which was initiated on December 27, 2000. The City Council agreed to exercise the purchase
agreement of February 18, 1999, during their regular meeting of February 27, 2001.
Complications that resulted from wetland mitigation caused the City Council to meet in closed
session to discuss the matter with the Attorney. Based upon the discussion with the Attorney
during the closed session meeting on July 5, and a privileged attorney/client session, the
settlement agreement is now presented for formal acceptance. Mr. Norman noted that ACCAP
had requested one change to the settlement agreement, which would allow for one single-family
unit group home.

City Attorney Goodrich noted that State law states that a residential property cmmot be barred
from becoming a group home. He stated that he did not think that what ACCAP had requested
gave them any additional rights.

Councilmember Kurak inquired if ACCAP was asking for anything that exceeded the existing
zoning.

City Attorney Goodrich replied no.

Councilmember Kurak inquired as to why the City has to stipulate any number of units if
ACCAP will be required to follow the current zoning.

City Council/July 10, 2001
