Organization. The exterior building materials for the building are proposing to consist of
rockface and smooth face concrete block, a glass front, and a pre-finished metal canopy. Staff
and the Planning Commission are supportive of the proposed accent glass portion of the
building; however, City Code does not specify that glass is a permitted building material in the
BW district and, therefore, requires City Council approval. The landscaping plan meets city
standards. The facility will be served by municipal sewer and water. The Planning Commission
recommended approval contingent upon compliance with staff review letter dated July 6, 2001,
and revised July 20, 2001.

Motion by Councilmember Anderson, seconded by Councilmember Kurak, to approve the
proposed site plan for RJM Enterprises contingent upon compliance with City staff review letter
dated July 6, 2001, revised July 20, 2001.

Motion carried. Voting Yes: Mayor Gamec, Councilmembers Anderson, Kurak, Hendriksen,
and Zimmerman. Voting No: None.

Case #7: Acquisition of Land for Well House #3

City Attorney Goodrich stated that the City has been in negotiations with the property owner
where Well House #3 will be constructed.. Recently staff and the City Attorney reached a
negotiated price for the property acquisitiOn and the matter was discussed in a closed session
prior to the Council meeting.

Motion by Mayor Gamec, seconded by Councilmember Kurak, to authorize the City Attorney
and the City Administrator to enter into a settlement agreement with the property owner for
approximately two acres for Well House #3 and to pay $100,000 to settle the lawsuit.

Further discussion: Councilmember Hendriksen stated that $50,000 an acre is unacceptable.

Motion carried. Voting Yes: Mayor Gamec, Councilmembers Kurak, and Anderson. Voting
No: Councilmembers Hendriksen and Zimmerman.

Case #8: Amendments to Ramsey City Ordinance #98-02 (Tobacco Ordinance)

Police Chief Gustafson stated that perthe direction received at the July 10, 2001 City Council
meeting, staff prepared the amendments to City Ordinance #98-02. The cost of the class would
be $195 per session. If they hold three classes a year, it would cost the City $585 to conduct
those seminars. As the tobacco retailers increase, the cost of the seminars would not, but the cost
of the City Clerk would. All technical equipment needed to conduct the seminars has already
been purchased with funds from a Minnesota Department of Health Grant received early in 2001.
This equipment should last for several years. All other written material is available either on the
internet or can be obtained free of charge from the Department of Health. Staff time for each
seminar/presentation would be two hours for the Crime Prevention Specialist and one hour each
for the Chief and City Prosecutor or City Attorney. There are currently 22 licensed tobacco

City Council/July 24, 2001
