This is not a request for a new business; it is the sale of a
current business. The manager of the establishment will be Jeremy Havrilla.

Citizen Input

There was none.

Motion by Councilmember Zimmerman, seconded by Councilmember Anderson, to close the
public hearing.

Motion carried. Voting Yes: Mayor Gamec, Councilmembers Zimmerman, Anderson,
Hendriksen, and Kurak. Voting No: None.

The public hearing closed at 7:38 p.m.

Council Business

Mayor Gamec called the regular City Council meeting back to order at 7:38 p.m.

Police Chief Gustafson noted that Mr. Carlson has withdrawn from the partnership, but the name
of the partnership will remain the same. Staff is still in need of receiving financial information
before the license can be issued. Section 7.52.09 of City Code states that within 45 days after the
public hearing the Council may either grant or deny the license or if the license is approved the
Council may delay issuance. The City Attorney has indicated that the Council could approve the
license, but should withhold the issuance until the business owners come forth with the new list
of officers and the financial withholdings.

Councilmember Hendriksen suggested tabling the issue until all of the information is received.

City Attorney Goodrich replied that the Council could table action, but he recommended adding
language to the motion that would make the approval contingent upon the proper license
application information being received as determined by the Police Chief pursuant to City Code.

Councilmember Hendriksen felt that the Council should be making the decision of whether or
not to approve the license after the information is received.

Mayor Gamec replied that he was comfortable with placing the responsibility on the Police
Chief.

Councilmember Anderson inquired as to who would be the owners of the company. She noted
that the application seemed unclear as to who actually had ownership in the company.

City Council/July 24, 2001
