Voting No: None. <br /> <br />Case #5: Consider Introduction of Trespassing Ordinance <br /> <br />City Administrator Norman stated that earlier in the summer, the Ramsey Police Department <br />ticketed four juveniles, who were sitting on the landfill watching fireworks. The Anoka County <br />Attorney's office refused to proceed with the matter because State Statute does not prohibit such <br />activities. Simply walking on a property that has a "no trespassing" sign or a fenced in area does <br />not trigger a trespassing violation. If an individual is asked to leave and they refuse to leave, or <br />if the individual is asked to leave and they return, they can be cited for trespassing under State <br />Statue. The County Attorney's office suggested that the City adopt a trespassing ordinance <br />similar to the Coon Rapids trespassing ordinance, in order to prosecute for such violations. Staff <br />would encourage the Council to consider a trespassing ordinance in the interest of cooperating <br />with the Minnesota Pollution Control Agency in their management of the closed Ramsey-Anoka <br />landfill. <br /> <br />Motion by Councilmember Hendriksen, seconded by Councilmember Zimmerman, to direct the <br />City Attorney to draft a Trespassing Ordinance for further action. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Zimmerman, <br />Anderson, and Kurak. Voting No: None. <br /> <br />Case #6: Set Special Election Date to Consider Charter Amendments Issues <br /> <br />City Administrator Norman stated that the City Council considered the establishment of a special <br />election to consider Charter amendment questions during its meeting of July 24, 2001. The <br />special election date was set at October 16, 2001. During a Charter Commission meeting held on <br />August 9, 2001, the Commission formally moved to recall those Charter amendments forwarded <br />to the City Council and to resubmit the same proposed amendments to the City Council for its <br />August 28, 2001 meeting. This action allows for an extension of the 90-day period, which by <br />State Statute is the required time period in which the City Council must schedule the special <br />election. The Charter Commission also recommended that City Council establish a special <br />election date for November 6, 2001, rather than the special election date previously authorized of <br />October 16, 2001. The reason for the date change from October 16, 2001, to November 6, 2001, <br />is for a variety of reasons. Many municipalities in the Metropolitan Area already have regular <br />off-year elections on the first Tuesday of November, including hotly contested elections in both <br />Minneapolis and St. Paul. Additionally, the Anoka-Hennepin School District has school board <br />elections and possibly a voter referendum to consider an operating budget issue. Staff has also <br />learned that for those areas of the City within the Anoka-Hennepin School District, the School <br />District will share expenses with the City at a rate of 50 percent. <br /> <br />City Council/August 14, 2001 <br /> Page 10 of 13 <br /> <br /> <br />
