fees run out during a subsequent final platting of a future phase. There is a stormwater <br />management development fee of $58,875 (157 units x $375/unit) due on the ultimate plat as <br />reflected in the approved preliminary plat. Preliminary Plat approval was contingent upon <br />addressing the drainage outlet to the north. At the time of preliminary plat, costs for this offsite <br />improvement were estimated at $130,000, and would provide a positive flow outlet to the Rum <br />River. Since that time the costs have been revised to $75,000, due to the presence of City owned <br />storm sewer on 156th Lane NW that could be utilized. The Developer would be responsible for <br />these costs. As mentioned at the time of preliminary plat approval, the City has requested that a <br />storm sewer overflow be included as part of this plat to protect the homes south of Alpine Drive <br />NW. The cost to construct this outlot is estimated at $50,648. Since this improvement does not <br />benefit the development, the Developer' has proposed that this improvement be constructed in <br />lieu of cash payment. The remaining $8,227 ($58,875 - $50,648) shall be paid in cash. It should <br />be the Developer's option to pay the $8,227 and lock ,in the 2001 trunk fee rate or pay this <br />additional money when his credited trunk fees run out during a subsequent final platting of a <br />future phase. The Developer has requested that verbiage be added to the Development <br />Agreement to require that the City pay for improvement costs that exceed the sewer and water <br />trunk charges as well as stormwater management fees. The estimated costs of the Phase I <br />improvements internal to the plat were not available at the time of case preparation. These costs <br />are wholly the Developer's responsibility, but are needed to complete the financial guarantees <br />and inspection fees section of the Developer's Agreement. <br /> <br />City Engineer Olson explained that the issue pertaining to the sewer and water trunk fees and <br />storm sewer has not been worked out in the development agreement. Mr. Olson presented a <br />letter to the Council from Steve Ach, Land Development Manager for Centex Homes, dated <br />December 18, 2001, giving their opinion on the outstanding issues. Mr. Olson explained that <br />some discussion needed to occur as it relates to who would be responsible for any cost associated <br />for sewer and water extension to the site if it exceeds the amount of the sewer and water trunk <br />fees noting that there will be about $278,000 in trunk fees generated. The estimated cost to run <br />sewer and water to the site is $250,000. <br /> <br />Councilmember Hendriksen inquired as to what past practice has been. <br /> <br />City Engineer Olson replied that Apple Ridge was required to pay for all extension costs to the <br />site over and above what was collected in trunk fees. <br /> <br />Councilmember Hendriksen stated that he had thought the purpose of the trunk fees was to pay <br />for looping, etc., in the City. <br /> <br />City Engineer Olson replied that that is correct when trunk fees are collected from parcels that <br />already have City sewer and water to the site. <br /> <br />Councilmember Hendriksen inquired as to how the City will ever pay back the costs associated <br />with extending City sewer and water into the City if the developer uses the entire fee to extend <br />sewer and water to their site. <br /> <br />City Engineer Olson replied that there are situations where sewer and water is extended through <br />undeveloped property and then all the fees would be placed in the trunk charge fund. <br /> <br />City Council/December 18, 2001 <br /> Page 17 of 27 <br /> <br /> <br />
