Community Development Assistant Wald replied yes.

Director of Public Works/Fire Chief Kapler noted that the only issue with private streets is that
the City of Ramsey is not geared to take care of the streets and does not intend to ever maintain
the private streets.

Motion by C~cilmember Kurak, seconded by Councilmember Hendriksen, to adopt Resolution
#01 12 ~ adopting Findings of Fact #0589 relating to a request to rezone the subject property
from B-1 Business to R-3 Urban Residential adding a finding to state "That the proposed
rezoning and development of the property will require a Comprehensive Plan amendment to
expand the MUSA boundary to include the subject property."

Motion carried. Voting Yes: Mayor Gamec, Councilmembers Kurak, Hendriksen, Anderson,
and Zimmerman. Voting No: None.

Motion by Councilmember Kurak, seconded by Councilmember Zimmerman, to introduce an
ordinance to rezone the subject property from B-1 Business to R-3 Urban Residential based on
the Findings of Facts.

Motion carried. Voting Yes: Mayor Gamec, Councilmembers Kurak, Zimmerman, Anderson,
and Hendriksen. Voting No: None.

Councilmember Hendriksen noted that the City has changed more property from business to
residential and they need to remember that in other areas of the City.

Case #7:

Request to Rezone Property from B-1 Business to R-3 Urban Residential;
Case of Eighty Seven LLC

Principal Planner Trudgeon stated that Eighty Seven LLC has submitted an application to rezone
the property located in the southwest quadrant of T.H. #47 and 153rd Avenue NW from B-1
Business to R-3 Urban Residential. The rezoning would allow the applicant to develop
townhomes on the property. The property is approximately 8.75 acres in size and is within the
Metropolitan Urban Service Area (MUSA). The general development plan that accompanied the
application proposes to develop the property with townhomes at a density not to exceed seven
units per acre. The current Comprehensive Plan (1995) identifies this area for development with
commercial uses. The March 2001 Draft Comprehensive Plan proposes to change the land use of
the subject property from commemial to medium density residential. The new Comprehensive
Plan has not been finalized and adopted; therefore, if the rezoning is approved, an amendment to
the current Comprehensive Plan (1995) will be required. Properties to the south and west of the
subject property are zoned R-1 Residential; properties on the north side of 15Ta Avenue and the
east side of T.H. #47 are zoned B-1 Business. The Planning Commission conducted the public
hearing, reviewed the request, and recommended City Council approval of the proposed
rezoning.

City Council/December 11, 2001
