Gary Jacobs, 8981 - 160th Lane NW, Ramsey, stated that the Planning Commission <br />recommended that the Northfork Association address the issue, but once that was done the <br />Planning Commission chose to deny the request. <br /> <br />Councilmember Zimmerman inquired as to when digging was completed. <br /> <br />City Engineer Jankowski replied September 2000. <br /> <br />Councilmember Kurak stated that it was her understanding that a portion of the berm was placed <br />on property that the Van Norman's and Jacobs's do not own. <br /> <br />Mr. Van Norman replied that was correct explaining that the land is owned by North Fork Inc. <br />and was held for a berm. He felt that between those two areas it appeared <br />that they could come up with a solution to resolve the issue and meet the code requirements. <br /> <br />Councilmember Kurak inquired if North Fork, Inc. would be in agreement with that solution. <br /> <br />City Engineer Jankowski replied that he did speak to Mr. Peck from North Fork, Inc. and' it was <br />his opinion that it would be a reasonable solution, but would need to discuss it further with other <br />employees. <br /> <br />Councilmember Anderson stated that the other alternative would be to haul out the soft. <br /> <br />Councilmember Kurak replied that the problem with that is that they can't get machinery into the <br />site to remove the material. <br /> <br />City Attorney Goodrich recommended tabling action so that they could get North Fork Inc. <br />involved in the discussions. <br /> <br />Mr. Van Norman noted that a 12 percent slope requirement is unreasonable. <br /> <br />City Council/November 27, 2001 <br /> Page 14 of 22 <br /> <br /> <br />
