Mayor Gamec replied that the City has an ordinance that they have to follow. <br /> <br />City Attorney Goodrich stated that he was not prepared to make any recommendation on the <br />issue without further information. <br /> <br />Patty McGurk, 8991 - 162"d Lane NW, Ramsey, stated that the outlot is between the back of her <br />property and the Van Norman's. She explained that when she purchased her lot they were told <br />there would be nothing behind them and now they have homes behind them so she does <br />understand that things change. In regards to subsequent ponds being constructed, North Fork, <br />Inc. dug some of the ponds and she would assume that they did get the proper permits. She <br />would agree that there is rye growing on the berm, but she is concerned that without topsoil and <br />irrigation will it continue to grow in the middle of the summer. Her opinion of the Board of <br />Directors at the North Fork Association is that they are no good. They took the opinion that the <br />berm is already done so they should just ignore it, but from now on they will crack down and <br />make people follow the rules. There were complaints from four homeowners, but they found out <br />they were in the minority because they asked 25 homeowners which did not look at the berm on <br />a daily basis. Her main concern as to do with how the berm looks~ <br /> <br />City Attorney Goodrich inquired if it was Ms. McGurk's opinion that covenants are being <br />violated. <br /> <br />Ms. McGurk replied that that was very sketchy. She explained that the Board was not sure if it <br />would have held up in the court of law. <br /> <br />Scott Christensen, 8970 - 162~d Lane NW, Ramsey, stated that he backs the berm and is looking <br />for some sort of remedy. He certainly felt that the berm could be reduced without hauling out a <br />significant amount of dirt. The outtots are owned by North Fork, Inc. not the homeowners <br />association and they are in the process of platting the outlots and selling them to the <br />homeowners. He would like some guarantee that there be landscaping that would be <br />aesthetically pleasing. <br /> <br />Councilmember Anderson inquired if the mining and grading ordinance had specifics as far as <br />growing grass and the requirement of topsoil. <br /> <br />City Engineer Jankowski replied yes and reviewed the language included in the ordinance. <br /> <br />Councilmember Hendriksen stated that the'configuration of Outlot B looks something like a trail, <br />he questioned what the original intent was of Outlot B. <br /> <br />Community Development Director Frolik stated that Outlot B was not meant to be a trail, noting <br />that it is owned by the Homeowners Association. <br /> <br />Councilmember Zimmennan inquired if there are any plans for Outlot B. <br /> <br />City Council/November 27, 2001 <br /> Page 15 of 22 <br /> <br /> <br />
