Councilmember Zimmerman stated that he did not think there was a problem with paragraph one <br />in Section 2. <br /> <br />Councilme~nber Anderson inquired as to why the City would be giving preferential treatment to <br />certain property owners. <br /> <br />Councihnember Zimmerman inquired if Ms. Anderson felt that all property owners should be <br />required to comply with density transitioning. <br /> <br />Councilmember Anderson replied yes. <br /> <br />Councilmember Zimmerman stated that he would like to know why the language was included <br />before making the decision to remove it. <br /> <br />Mayor Gamec inquired as to what would happen if a property owner waives their right to density <br />transitioning and then changes their mind. <br /> <br />Mr. Bakken replied that once a property owner has agreed to waive their rights, then the decision <br />is final. <br /> <br />Mayor Gamec inquired if that would be good for development in the urban areas. <br /> <br />Councilmember Kurak inquired as to what would happen if a property were to waive the density <br />transition requirements and then sells the property. <br /> <br />Mr. Bakken replied that he would assume that the waiver would stay with the property. <br /> <br />Councilmember Zimmerman stated that he would agree with removing paragraphs one and two <br />from Section 2. <br /> <br />Councilmember Hendriksen stated the he would like a different word than "impractical" for <br />paragraph 3 under Section 2. <br /> <br />Mr. Bakken recommended changing the word "impractical" to "undesirable". <br /> <br />Consensus of the Council was to remove paragraphs one and two from Section 2 and change the <br />word "impractical" to "undesirable" in paragraph 3. <br /> <br />Mr. Bakken inquired as to what the Council wanted to do with Section 4. <br /> <br />Mayor Gamec replied that Section 4, d. should be deleted. <br /> <br />Councilmember Anderson agreed that Section 4, d. should be deleted. <br /> <br />City Council/November 26, 2001 <br /> Page 4 of 11 <br /> <br /> <br />
