Councilmember Hendriksen stated that he is very sympathetic with Mr. Enstrom because he is <br />trying to deal with all the agencies, which is a horrendous task. Having said that there are a <br />number of things in the conditional use permit that Mr. Enstrom does not agree with so there are <br />probably several things that should be changed in the conditional use permit before it is <br />approved. The City should not issue a conditional use permit that the applicant cannot abide by. <br />He felt that there were too many issues that needed to be addressed that he did not think they <br />could approve the conditional use permit at this time. He inquired as to what could be done to <br />allow Mr. Enstrom to proceed without issuing a new conditional use permit at this time. <br /> <br />City Attorney Goodrich replied that the only choice the Council has if they want to permit Mr. <br />Enstrom to continue his operation would be to issue a new conditional use permit. <br /> <br />Councilmember Hendriksen inquired if it was possible to issue a conditional use permit for only <br />30 days. <br /> <br />City Attorney Goodrich replied no. <br /> <br />Mayor Gamec stated that the operation has been occun'ing for some time and there have not been <br />any problems with the operation and for those reasons he was willing to approve the conditional <br />use permit with the original conditions. He inquired if the WMO could conduct a special <br />meeting to address the WMO permit that is needed. <br /> <br />City Engineer Jankowski reviewed the process of what occurs when someone applies for a WMO <br />permit, which would make it unlikely that a special meeting would be held to address the issue. <br /> <br />Councilmember Hendriksen stated that he did not understand why they would issue a conditional <br />use permit when there are conditions that the applicant is not willing to operate under or simply <br />cannot operate under, noting that he would like to do something to help resolve the issue. <br /> <br />City Attorney Goodrich replied that at this time the City could issue the ability to remove already <br />excavated material, but they cannot issue the ability to excavate material until the applicant <br />receives all the required permits from other organizations. <br /> <br />Coul~cilmember Anderson inquired as to what the reasons were for the hours of operation. <br /> <br />Councihnember Hendriksen felt that the Council was rushing through the process because they <br />had limited time to handle the case, which he did not think was proper. He inquired as to why <br />the Council could not issue a conditional use permit for one month so that Mr. Enstrom could <br />continue with his business and it would allow the City to work out the questionable conditions. <br /> <br />City Attorney Goodrich replied that if the Council were to issue a conditional use permit for only <br />30 days the applicant would have to reapply and an all new public hearing would have to be <br />scheduled. <br /> <br />City Council/November 20, 2001 <br /> Page 5 of 12 <br /> <br /> <br />
