Cotmcihnember Kurak inquired as to what the cost was to the applicant to reapply. <br /> <br />Mr. Enstrom replied $350. <br /> <br />City Administrator Norman noted that the Council could waive the fee. <br /> <br />Councihnember Anderson inquired if the hours of operation that are included in the conditional <br />use permit are standard hours. <br /> <br />City Engineer Jankowski noted that the cease and assist order was issued on the property because <br />the conservation officer was not clear if what was occurring was legal. Mr. Enstrom had the <br />ability to prove that he was not in violation or to get the necessary permits. That process is what <br />will occur through the WMO permit process. <br /> <br />Councilmember Kurak stated that any motion to approve the conditional use permit would be <br />contingent UpOll receiving the WMO permit. The other issues that needed to be discussed have <br />to do with the hours of operation and the slopes. <br /> <br />City Attorney Goodrich inquired if the Council wanted the conditional use permit to be issued <br />for six months or three years. <br /> <br />Councihnember Kurak replied that she felt the conditional use permit should be issued for three <br />years. <br /> <br />Councilmen~ber Zimmerman felt the issue should go back to the Planning Commission for <br />review. <br /> <br />The majority consensus of the Council was that the conditional use permit should be issued for <br />three years. <br /> <br />City Attorney Goodrich inquired if finding # 10 should read will or will not. <br /> <br />Consensus of the Council was that it should read will not. <br /> <br />Motion by Councihnember Hendriksen, seconded by Councilmember Zimmerman, to allow for <br />discussion after each finding that is in dispute. <br /> <br />Motion carried. Voting Yes: Councilmembers Hendriksen, Zimmerman, and Anderson. Voting <br />No: Mayor Gamec, and Councilmember Kurak. <br /> <br />Councilmember Hendriksen stated that finding #11 stated that the proposed use would not be <br />unduly dangerous, but there have been issues discussed relative to the slopes. He inquired if the <br />applicant was going to abide by the slope requirements or are the requirements going to be <br />changed to something the applicant can comply with. <br /> <br />City Council/November 20, 2001 <br /> Page 6 of 12 <br /> <br /> <br />
