Councilmember Kurak felt that the issue could be addressed after the findings of fact are <br />approved. <br /> <br />Councihnember Hendriksen replied that he did not feel that they could properly answer the <br />questions without addressing that issue. <br /> <br />City Engineer Jankowski noted that the wording that is included in the conditional use permit <br />pertaining to the slopes is what is required by City ordinance. <br /> <br />City Attorney Goodrich recommended that finding #11 read as follows: "That the proposed use <br />will not be unduly dangerous or otherwise detrimental to persons residing or working in the <br />vicinity of the use or to the public welfare, if the conditions of the conditional use permit are <br />complied with. <br /> <br />Consensus of the Council was to amend finding #11 as recommended by the City Attorney as <br />well as to make the changes to the following findings: <br /> <br />· Finding #12 amended to read will not. <br />· Finding #13 amended to read will not. <br />· Finding #14 amended to read "That the proposed use will not be disturbing to existing <br /> neighboring uses during the tenThS of the permit if the conditions of the conditional use permit <br /> are complied with." <br />· Finding #15 amended to read will. <br />· Finding #16 amended to read will not in both locations. <br />· Finding #17 amended to read "That the proposed activities, processes, materials, and <br /> equipment and conditions of operation will not be detrimental to any persons, property, or the <br /> general welfare by reason of excessive production of traffic, noise, smoke, fumes, glare, or <br /> odors if the conditions of the conditional use permit are complied with." <br />· Add Finding # 18 to read "That a permit for the use may be required by the MPCA. <br />· Add Finding # 19 to read "That a permit from the WMO may be required." <br /> <br />Councilmember Hendriksen inquired if the applicant would agree to provide proper <br />documentation regarding the necessary permits, to the City, prior to commencing operation. <br /> <br />Mr. Enstrom replied yes. <br /> <br />Councihnember Hendriksen recommended that Finding #20 be added as follows: "That the <br />applicant has agreed to provide copies of the permits or letters indicating that permits are needed <br />prior to commencing operation." <br /> <br />Consensus of the Council was to add Finding #20 as recommended by Councilmember <br />Hendriksen. <br /> <br />City Council/November 20, 2001 <br /> Page 7 of 12 <br /> <br /> <br />
