COUNCIL BUSINESS

Case #1:

Request for Preliminary Plat and Site Plan Approval of Shade Tree
Cottages; Case of Shade Tree Communities, LLC

Mayor Pro Tern Elvig indicated Case Nos. 1 through 4 are for two projects that feed off of
Potassium Street. The last time these cases were discussed there were concerns about Potassium
Street that have not been resolved at this time.

Community Development Director Trudgeon explained one of the main topics of discussion
concerning these projects at the last Council meeting was in regard to Potassium Street. The
Council tabled action and directed staff to contact the additional property owners that would be
affected by Potassium Street.

City Attorney Goodrich reviewed that at the last Council meeting one of the resolutions was to
consider eminent domain in the event the City was unable to negotiate the right-of-way for
Potassium Street. The Council directed staff to contact all of the property owners affected by
Potassium Street. Today staff was able to meet with Mr. Mott and Mr. Weichelt, and they are
interested in seeing that the road be 33 feet on their property and 33 feet on the property to the
west. Staff has not been able to speak with the Lamonts, but will meet with them next
Wednesday at 6:00 p.m. A couple of the neighbors have indicated that the Lamonts would likely
be more impacted by the road than anyone, but staff needs to meet with them. Staff continues to
have an agreement in principal with the properties aligned to the north, but does not have an
agreement on anything south of the Hampton Parcel.

Motion by Councilmember Cook, seconded by Councilmember Olson, to table Case Nos. 1
through 4 to the next City Council meeting.

Motion carried.
