Mayor Gamec stated that there are a lot of things that they don't have positive answers on. They <br />know there will eventually be a rail station, but the location is uncertain so do they wait for that <br />location before they proceed because around the station is where they would probably want to <br />place the commercial and residential development. <br /> <br />Mr. Bakken noted that the City could develop the land in stages and develop priorities for certain <br />types of developments. <br /> <br />Councilmember Kurak stated that the Council is trying to get the Comprehensive Plan made for <br />the City, but she does not feel qualified as a city developer or a planner. She felt that the Council <br />should be more concerned with the zoning of the mixed-use rather than where it will be located. <br /> <br />Councihnember Hendriksen stated that every mixed-use site they visited in Chicago stated that <br />the City should have control of the property before it is developed. <br /> <br />Councilmember Kurak replied that she did not see that happening on this property. <br /> <br />Mr. Bakken inquired as to how much influence the City Council has on a plan that is presented. <br /> <br />Councilmember Kurak stated that that is what she is concerned about. <br /> <br />Mr. Bakken replied that it is not unusual to set priorities for the site. <br /> <br />Councihnember Kurak stated that she is concerned that if commercial is a permitted use and a <br />developer proposes a strip mall, but that is not what the Council envisioned for the property, <br />what control does the City have to prevent the strip mall from being constructed. <br /> <br />Mr. Bakken recommended that the Council list priorities that have to be met. <br /> <br />Councilmember Anderson inquired if the Council could make those priorities stick if they fall <br />under the basic category of mixed-use. <br /> <br />Mr. Bakken replied that the City could go out and shop developers. <br /> <br />Councilmember Hendriksen stated that his concern is that with high density residential being a <br />permitted use, the site could be developed with all high density residential. He inquired if the <br />new wording that was presented by staff would hold up in court. <br /> <br />Mr. Bakken replied that he felt that #8 would stand-up in court. <br /> <br />Councilmember Hendriksen stated that he has been told by an attorney that a city cannot specify <br />a certain percentage for residential development etc., which is why he would like a legal opinion <br />on the language presented. <br /> <br />Councilmember Kurak stated that is why the City needs to have the proper zoning in place for <br />the mixed-use site. <br /> <br />City Council/October 15, 2001 <br /> Page 3 of 10 <br /> <br /> <br />
