is a standard ten-foot wide drainage and utility easement on the common property line between <br />the two lots. The City should not issue building permits over drainage and utility easements and <br />a vacation of the easement is necessary. There are no utilities existing in the easement to be <br />vacated. The City Engineer indicates that the vacation of this easement will not impact the <br />drainage plan for the area. <br /> <br />Citizen Input <br /> <br />There was none. <br /> <br />Motion by Councilmember Hendriksen, seconded by Councilmember Zimmerman, to close the <br />public hearing. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Zimmerman, <br />Anderson, and Kurak. Voting No: None. <br /> <br />The public hearing closed at 7:27 p.m. <br /> <br />Council Business <br /> <br />Mayor Gamec called the regular City Council meeting back to order at 7:27 p.m. <br /> <br />Motion by Councilmember Hendriksen, seconded by Councilmember Zimmerman, to introduce <br />an ordinance to vacate certain drainage and utility easements in Northfork Oaks 4th Addition. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Zimmerman, <br />Anderson, and Kurak. Voting No: None. <br /> <br />Case #2: <br /> <br />Request for Vacation of Easements; Case of TEC Design and Homestead <br />Multi-Family Development Corporation <br /> <br />Mayor Gamec closed the regular portion of the City Council meeting at 7:28 p.m. in order to <br />conduct a public hearing. <br /> <br />Public Hearing <br /> <br />Mayor Gamec called the public hearing to order at 7:28 p.m. <br /> <br />Presentation <br /> <br />Community Development Director Frolik stated that earlier this year, Council approved the final <br />plat for Orchard Hills, a townhome development. The subdivision of Orchard Hills included a <br />portion of Rademacher Addition and required a replat of the area. This previously platted parcel <br />in Rademacher Addition contained the standard drainage and utility easements around the <br /> <br />City Council/October 9, 2001 <br /> Page 5 of 24 <br /> <br /> <br />
