City Attorney Goodrich replied that Infinity did agree with the $29,000. <br /> <br />City Engineer Olson explained that Infinity has defined approximately $13,000 in out of pocket <br />expenses and the additional $16,000 for the loss of profit. <br /> <br />Councilmember Anderson inquired if the SCADA system was part of the 2000 bidding process. <br />City Engineer Olson replied yes, noting that they did not give an option for a deduct last year. <br /> <br />City Attorney Goodrich recommended that the motion include the following wording: "and <br />terminate the August 2000 contract with Infinity Builders at a cost not to exceed $29,000." <br /> <br />Motion by Councilmember Kurak, seconded by Councilmember Hendriksen, to adopt Resolution <br />#01-10-379 awarding the contract including installation of a generator and construction of <br />Pumphouse No. 3 to Magney Construction, Inc. in the amount of $495,500 and to terminate the <br />August 2000 contract with Infinity Builders at a cost not to exceed $29,000. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Kurak, Hendriksen, Anderson, <br />and Zimmerman. Voting No: None. <br /> <br />Councilmember Zimmerman requested that staff has the real estate before they move forward <br />with a project in the future. <br /> <br />Case #4: Receive Bids and Award Contracts for Improvement Project #01-31, Well <br /> No. 5 Connection <br /> <br />City Engineer Olson stated that Improvement Project #01-31 consists of approximately 3,000 <br />feet of 16-inch watermain to connect the existing well south of C.R. #116 to the existing water <br />supply west of C.R. #116 and Ramsey Boulevard. Authorization to advertise for bids was <br />ordered on August 14, 2001, and bids were received Wednesday, September 19, 2001. Nine bids <br />were received and ranged from $138,690 to $189,362.
